AN ACT
Amending Title 42 (Judiciary and Judicial Procedure) of the
Pennsylvania Consolidated Statutes, in detainers and
extradition, providing for coordination with Department of
Homeland Security.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The heading of Subchapter D of Chapter 91 of
Title 42 of the Pennsylvania Consolidated Statutes is amended to
read:

MISCELLANEOUS PROVISIONS
Section 2. Title 42 is amended by adding a section to read:
ยง 9172. Coordination with Department of Homeland Security.
(a) Voluntary notification of release.--When the Department
of Homeland Security issues a Form I-247N (Request for Voluntary
Notification of Release of Suspected Priority Alien) in which
the Department of Homeland Security requests that a State or

local law enforcement agency notify the Department of Homeland
Security of the pending release from custody of an individual,
the State or local law enforcement agency shall notify the
Department of Homeland Security not less than 48 hours prior to
the individual's release.
(b) Request for voluntary action.--Upon the Department of
Homeland Security issuing a Form I-247D (Immigration Detainer -
Request for Voluntary Action) to a State or local law
enforcement agency requesting the agency maintain custody of an
individual for a period not to exceed 48 hours beyond the time
that the individual would have otherwise been released from
custody, the State or local law enforcement agency shall
maintain custody of the individual for a period of not more than
48 hours in order to permit the Department of Homeland Security
to assume custody of the individual, regardless of whether the
individual is eligible for bail.
Section 3. This act shall take effect in 60 days.
