AN ACT
Providing for study requirements prior to transferring a power,
duty or function of a Commonwealth agency.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Study requirements.
(a) General rule.--Notwithstanding any other act to the
contrary, there shall be no transfer of a power, duty or
function of a Commonwealth agency until the following studies
are completed:
(1) A study on the financial impact of the
reorganization by the Legislative Budget and Finance
Committee.
(2) A study on the policy and programmatic implications
and the impact on service delivery of the reorganization by
the Joint State Government Commission.
(b) Timing and submission.--The studies required under this
act shall be completed within one year of the intended effective

date of a transfer described under subsection (a). The studies
shall be submitted to all of the following:
(1) The following committees of the Senate:
(i) Aging and Youth Committee.
(ii) Appropriations Committee.
(iii) Health and Human Services Committee.
(2) The following committees of the House of
Representatives:
(i) Aging and Older Adult Services Committee.
(ii) Appropriations Committee.
(iii) Health Committee.
(iv) Human Services Committee.
(c) Reorganization restriction.--Sections 4 and 5 of the act
of April 7, 1955 (P.L.23, No.8), known as the Reorganization Act
of 1955, shall not apply to a transfer described under
subsection (a) until the studies required under this act are
completed or until specific legislation is enacted by the
General Assembly for this purpose.
Section 2. Effective date.
This act shall take effect in 60 days IMMEDIATELY.
