AN ACT
Amending Title 42 (Judiciary and Judicial Procedure) of the
Pennsylvania Consolidated Statutes, in sentencing, providing
for restitution for tampering with evidence or public records
or information.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 42 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
§ 9720.8. Restitution for tampering with evidence or public
records or information.
(a) General rule.--A court may, in addition to any other
restitution sentence or order authorized by law, sentence a
person convicted of a violation of 18 Pa.C.S. § 4910 (relating
to tampering with or fabricating physical evidence) or 4911
(relating to tampering with public records or information) to
make restitution for all reasonable expenses incurred by the
victim or on the victim's behalf to:
(1) investigate the circumstances surrounding the
defendant's violation of 18 Pa.C.S. § 4910 or 4911;

(2) bring or defend civil or criminal actions related to
the defendant's violation of 18 Pa.C.S. § 4910 or 4911; or
(3) take other corrective or remedial efforts in
connection with the defendant's violation of 18 Pa.C.S. §
4910 or 4911.
(b) Types of expenses.--The types of expenses that may be
recoverable under this section include, but are not limited to:
(1) Attorney fees.
(2) Court costs and filing fees.
(3) Any other expense the court deems proper.
Section 2. The addition of 42 Pa.C.S. § 9720.8 shall apply
to offenses committed on or after the effective date of this
act.
Section 3. This act shall take effect in 60 days.
