AN ACT
Authorizing the Department of General Services, with the
approval of the Department of Human Services and the
Governor, to grant and convey to the Municipal Authority of
the Township of South Heidelberg, Berks County, or its
assigns, a permanent sanitary sewer easement and a temporary
construction easement situate in South Heidelberg Township,
Berks County.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Conveyance in South Heidelberg Township, Berks
County.
(a) Authorization.--The Department of General Services, with
the approval of the Department of Human Services and the
Governor, is hereby authorized on behalf of the Commonwealth of
Pennsylvania to grant and convey to the Municipal Authority of
the Township of South Heidelberg, Berks County, or its assigns,
a certain permanent sanitary sewer easement and a certain
temporary construction easement situate in South Heidelberg
Township, Berks County, for $1.00.
(b) Description.--The easements to be conveyed pursuant to
section 1 are more particularly described as follows:

ALL THAT CERTAIN permanent sanitary sewer easement, 30' in
width, situate south of Route 422 (S.R. 0422), east of its
intersection with Point Road, in South Heidelberg Township,
Berks County, Commonwealth of Pennsylvania, being more fully
bounded and described in accordance with a Forino Co., L.P. plan
titled "Vist Financial Off-Site Sanitary Sewer - Exhibit Showing
Proposed 30 foot Wide Sanitary Sewer Easement Over and Across
Lands of the Commonwealth of Pennsylvania," designated as
Project # 10530, Sheet 1 of 1, dated December 3, 2014, as
follows:
BEGINNING AT AN IRON PIN marking a corner of land common to
RLP Land Holdings, LLP (Instrument Number 2011025323, Berks
County records) and the Commonwealth of Pennsylvania, grantor
herein, located approximately 370 feet south of Route 422
opposite its intersection with Mountain Boulevard and being the
terminus point of the first described course along the
Commonwealth of Pennsylvania (North 52°18'56" East, 560.96 feet)
in said deed recorded as Instrument Number 2011025323;
THENCE along the common boundary of RLP Land Holdings, LLP
and the Commonwealth of Pennsylvania, North 58°14'33" West,
237.11 feet to the True Point of Beginning of the herein
described easement;
THENCE over and across land of the Commonwealth of
Pennsylvania, South 00°18'02" West, 341.07 feet to a point in
line of RLP Land Holdings, LLP;
THENCE along land of RLP Land Holdings, LLP, South 43°14'41"
West 44.03 feet;
THENCE again over and across land of the Commonwealth of
Pennsylvania, North 00°18'02" East, 391.65 feet to a point in
line of land of RLP Land Holdings, LLP;

THENCE along land of RLP Land Holdings, LLP, South 58°14'33"
East, 35.17 feet to the True Point of BEGINNING.
CONTAINING IN AREA 10,991 square feet. Course bearings for
the herein described permanent sanitary sewer easement are
relative to the Pennsylvania State Plane Coordinate Grid, South
Zone, 1983 North American Datum.
Together with a 30' wide Temporary Construction Easement
located on the eastern side of the herein described permanent
sanitary sewer easement as shown on the above referenced Forino
Co., L.P. plan.
The herein described easements are part of P.I.N. 4356-02-77-
7365.
(c) Conditions.--The conveyance shall be made under and
subject to all lawful and enforceable easements, servitudes and
rights of others, including, but not confined to, streets,
roadways and rights of any telephone, telegraph, water,
electric, gas or pipeline companies, as well as under and
subject to any lawful and enforceable estates or tenancies
vested in third persons appearing of record, for any portion of
the land or improvements erected thereon.
(d) Execution.--The conveyance shall be executed by the
Secretary of General Services in the name of the Commonwealth of
Pennsylvania.
(e) Costs and fees.--Costs and fees incidental to this
conveyance shall be borne by the Grantee.
(f) Expiration.--If this conveyance is not fully executed
within two years of the effective date of this section, the
authority contained in this section shall expire.
Section 2. Effective date.
This act shall take effect immediately.
