AN ACT
Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
act relating to the public school system, including certain
provisions applicable as well to private and parochial
schools; amending, revising, consolidating and changing the
laws relating thereto," in intermediate units, further
providing for subsidies for services.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 907-A of the act of March 10, 1949
(P.L.30, No.14), known as the Public School Code of 1949, is
amended by adding subsections to read:
Section 907-A. Subsidies for Services.--* * *
(c) The Department of Education shall use the information
from the reports to evaluate the performance of each
intermediate unit in implementing any contract, interagency
agreement, intergovernmental agreement, purchase order,
memorandum of understanding, agreement or other arrangement
between the department and the intermediate unit that exceeds
$50,000. The Department of Education shall annually rank the
performance of each intermediate unit against each other and

shall post the rankings on the department's publicly accessible
Internet website. The evaluation and rankings shall include an
assessment of:
(1) The number of students served by each contract and
agreement, the cost per student in fulfilling the contract
and agreement and the overhead costs of each contract and
agreement.
(2) The number and type of actions taken by schools to
improve student performance attributable to the contracts and
agreements.
(3) The yearly number and percentage of schools and
students increasing or decreasing in performance directly
attributable to each contract and agreement.
(d) Two years after the effective date of this subsection,
the Department of Education may rebid a contract or agreement
between the department and an intermediate unit that fails to
meet 80% of established goals.
(e) Within three years of the effective date of this
subsection, the Department of Education shall rebid a contract
or agreement between the department and an intermediate unit
that fails to meet 80% of established goals.
Section 2. This act shall take effect in 60 days.
