AN ACT
Amending the act of May 1, 1933 (P.L.103, No.69), entitled, as
reenacted and amended, "An act concerning townships of the
second class; and amending, revising, consolidating and
changing the law relating thereto," in corporate powers,
further providing for observances and celebrations.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 1540 of the act of May 1, 1933 (P.L.103,
No.69), known as The Second Class Township Code, reenacted and
amended November 9, 1995 (P.L.350, No.60), is amended to read:
Section 1540. Observances [and], Celebrations and
Recognitions.--The board of supervisors may appropriate moneys
for:
(1) the observance of holidays, centennials or other
anniversaries or for township celebrations or civic projects or
programs[.]; and
(2) the purpose of flowers, plaques or other tokens of
tangible personal property, other than cash, gift certificates
or equivalent items, in an amount not to exceed one hundred

dollars ($100), recognizing the service or passing of a township
official, employe or volunteer. The value of any tangible
personal property received by the township official, employe or
volunteer shall be considered of de minimis economic impact as
that term is defined in 65 Pa.C.S. § 1102 (relating to
definitions) and shall not be subject to reporting in accordance
with 65 Pa.C.S. § 1105 (relating to statement of financial
interests).
Section 2. This act shall take effect in 60 days.
