A RESOLUTION
Appointing a committee and empowering it to make investigation.
RESOLVED, By the House of Representatives of the General
Assembly of the Commonwealth of Pennsylvania, that the Judiciary
Committee be authorized to investigate the conduct of the
Honorable Kelly S. Ballentine, a Magisterial District Judge for
Lancaster County, to determine whether Kelly S. Ballentine is
liable to impeachment for misbehavior in office and to report to
the House the conclusions of the committee in respect to the
investigation and determination with its appropriate
recommendations; and be it further
RESOLVED, That the Judiciary Committee shall designate the
Subcommittee on Courts to take testimony, review documents or
other materials and interview witnesses for the use of the
Judiciary Committee. The Subcommittee on Courts is authorized
and empowered to:
(1) make recommendations to the Judiciary Committee and

in the performance of its duties;
(2) send for persons and papers and subpoena witnesses,
documents, and other materials under the seal of the
Subcommittee Chairman;
(3) administer oaths to witnesses;
(4) take testimony; and
(5) prepare and file pleadings and other legal
documents;
and be it further
RESOLVED, That upon receipt of the recommendations of the
Subcommittee on Courts, the Judiciary Committee be authorized
and empowered to:
(1) send for persons and papers and subpoena witnesses,
documents and other materials under the hand and seal of the
chairman;
(2) administer oaths to witnesses;
(3) take testimony;
(4) prepare and file pleadings and other legal
documents; and
(5) employ staff;
and be it further
RESOLVED, That a sergeant-at-arms or his deputy shall serve
the process of the Judiciary Committee and Subcommittee on
Courts and execute its orders. The Judiciary Committee and
Subcommittee on Courts are authorized to sit during the sessions
of this House. The expenses of the investigation shall be paid
out of an appropriate account of the Chief Clerk, except that if
any staff expenses or compensation are to be paid by the Chief
Clerk, the approval of the Bipartisan Management Committee shall
be required.
