AN ACT
Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
act relating to the public school system, including certain
provisions applicable as well to private and parochial
schools; amending, revising, consolidating and changing the
laws relating thereto," in school directors, providing for
abstention on collective bargaining agreements under certain
circumstances.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of March 10, 1949 (P.L.30, No.14), known
as the Public School Code of 1949, is amended by adding a
section to read:
Section 328. Abstention on Collective Bargaining Agreements.--
Notwithstanding the provisions of 65 Pa.C.S. ยง 1103 (relating to
restricted activities), a school director shall abstain from
voting on a collective bargaining agreement if:
(1) a spouse, child, sibling or parent of the school
director; or
(2) a person who, for purposes of filing a return under
Article III of the act of March 4, 1971 (P.L.6, No.2), known as

the Tax Reform Code of 1971, has the same address as the school
director,
is or would be subject to the collective bargaining agreement.
Section 2. This act shall take effect in 60 days.
