AN ACT
Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
Statutes, in serious traffic offenses, further providing for
fleeing or attempting to elude police officer.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 3733(a) and (a.2)(2)(iii) of Title 75 of
the Pennsylvania Consolidated Statutes are amended to read:
ยง 3733. Fleeing or attempting to elude police officer.
(a) Offense defined.--Any driver of a motor vehicle who
willfully fails or refuses to bring his vehicle to a stop, or
having stopped, fails to remain in or at his vehicle, or who
otherwise flees or attempts to elude a pursuing police officer,
when given a visual and audible signal to bring the vehicle to a
stop, commits an offense as graded in subsection (a.2).

(2) An offense under subsection (a) constitutes a felony
of the third degree if the driver while fleeing or attempting
to elude a police officer does any of the following:

(iii) endangers a law enforcement officer or member
of the general public due to the driver engaging in a
high-speed chase or by an action in violation of this
section, creates a risk of injury to anyone.

Section 2. This act shall take effect in 60 days.
