A RESOLUTION
1Amending Senate Ethical Conduct Rules 1 and 2.
2RESOLVED, That Rule 1 of the Ethical Conduct Rules of the
3Senate be amended by adding definitions to read:
4Rule 1. Preliminary provisions.
5As used in these rules, the following words and phrases shall
6have the meanings given to them in this rule unless the context
7clearly indicates otherwise:

9"Cash gift."
10(1) Any of the following:
11(i) United States or foreign currency.
12(ii) A money order.
13(iii) A check.
14(iv) A prepaid debit or credit card.
15(v) A gift card or certificate.
16(2) The term does not include:
1(i) A political contribution reported as required by
2law.
3(ii) A commercial loan made in the ordinary course
4of business.
5(iii) A transaction involving reasonable
6consideration of equal or greater value.
7(iv) A cash gift from a parent, sibling, spouse,
8child, stepchild, stepparent, stepsibling, grandparent,
9grandchild, parent-in-law or sibling-in-law when the
10circumstances make it clear that the motivation for the
11action was a personal or family relationship.
12(v) A cash gift available to the public or offered
13to members of a group or class in which membership is not
14related to being a Senator or Senate employee.
15(vi) An award or prize given to competitors in any
16contest or event open to the public, including random
17drawings.

19"Lobbyist." Any individual, firm, association, corporation,
20partnership, business trust or other entity that is registered
21as a lobbyist under 65 Pa.C.S. Ch. 13A (relating to lobbying
22disclosure).

24"Official action." An administrative action or legislative
25action, as those terms are defined in 65 Pa.C.S. § 13A03
26(relating to definitions).

28"Principal." Any individual, association, corporation,
29partnership, business trust or other entity that is registered
30as a principal under 65 Pa.C.S. Ch. 13A (relating to lobbying
1disclosure).

3RESOLVED, That Rule 2 of the Ethical Conduct Rules of the
4Senate be amended by adding a subsection to read:
5Rule 2. Practice.

7(h) Cash gifts.--No Senator or Senate employee shall accept
8or solicit a cash gift from any of the following:
9(1) A lobbyist or principal.
10(2) A person that is seeking official action from the
11Senator or Senate employee.
12RESOLVED, That the amendment of Rules 1 and 2 of the Ethical
13Conduct Rules of the Senate apply to cash gifts made on and
14after the adoption of this resolution.
