AN ACT

 

1Amending the act of October 5, 1978 (P.L.1109, No.261), entitled
2"An act requiring the licensing of practitioners of
3osteopathic medicine and surgery; regulating their practice;
4providing for certain funds and penalties for violations and
5repeals," providing for visiting team physician.

6The General Assembly of the Commonwealth of Pennsylvania
7hereby enacts as follows:

8Section 1. The act of October 5, 1978 (P.L.1109, No.261),
9known as the Osteopathic Medical Practice Act, is amended by
10adding a section to read:

11Section 7.2. Visiting team physician.

12(a) Licensure exemption.--A physician who is licensed to
13practice in another state shall be exempt from the licensure
14requirements of this act while practicing in this Commonwealth
15if either of the following apply:

16(1) The physician has a written or oral agreement with a
17sports team to provide care to the team members and coaching
18staff traveling with the team for a specific sporting event

1to take place in this Commonwealth.

2(2) The physician has been invited by a national sport
3governing body to provide services at a national sport
4training center in this Commonwealth or to provide services
5at an event or competition in this Commonwealth which is
6sanctioned by the national sport governing body so long as:

7(i) The physician's practice is limited to that
8required by the national sport governing body.

9(ii) The services provided by the physician must be
10within the area of the physician's competence.

11(b) Limitations.--A physician who is exempt under subsection
12(a) from licensure may not:

13(1) Provide care or consultation to any person residing
14in this Commonwealth other than a person delineated in
15subsection (a) or as otherwise provided by State law.

16(2) Practice at a health care clinic or health care
17facility including an acute care facility.

18(c) Duration.--An exemption under subsection (a) shall be
19valid for the following duration:

20(1) An exemption under subsection (a)(1) shall remain in
21force while the physician is traveling with the sports team
22but shall be no longer than ten days in duration per sporting
23event. A maximum of 20 additional days per sporting event may
24be granted upon prior request by the physician but may not
25exceed 30 days total.

26(2) An exemption under subsection (a)(2) shall remain in
27force during the time certified by the national sport
28governing body, which may not exceed 30 days.

29Section 2. This act shall take effect in 60 days.
