AN ACT

 

1Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2act relating to the public school system, including certain
3provisions applicable as well to private and parochial
4schools; amending, revising, consolidating and changing the
5laws relating thereto," providing for protection and defense
6of pupils.

7The General Assembly of the Commonwealth of Pennsylvania
8hereby enacts as follows:

9Section 1. The act of March 10, 1949 (P.L.30, No.14), known
10as the Public School Code of 1949, is amended by adding a
11section to read:

12Section 510.2. Protection and Defense of Pupils.--(a) The
13board of school directors in a school district may establish
14policy permitting school personnel access to firearms in the
15buildings or on the grounds of a school.

16(b) School personnel permitted access to firearms in the
17buildings or on the grounds of a school by the board of school
18directors must:

19(1) have a license to carry a concealed firearm; and

20(2) maintain a current and valid certification in the use

1and handling of a firearm issued under:

2(i) 53 Pa.C.S. Ch. 21 Subch. D (relating to municipal police
3education and training);

4(ii) the act of February 9, 1984 (P.L.3, No.2), known as the
5Deputy Sheriffs' Education and Training Act;

6(iii) the act of October 10, 1974 (P.L.705, No.235), known
7as the Lethal Weapons Training Act;

8(iv) the act of December 13, 2005 (P.L.432, No.79), known as
9the Retired Law Enforcement Identification Act; or

10(v) any other firearms program that has been determined by
11the Commissioner of Pennsylvania State Police to be of
12sufficient scope and duration as to provide the participant with
13basic training in the use and handling of firearms.

14Section 2. This act shall take effect in 60 days.
