AN ACT

 

1Amending the act of February 14, 2008 (P.L.6, No.3), entitled
2"An act providing for access to public information, for a
3designated open-records officer in each Commonwealth agency,
4local agency, judicial agency and legislative agency, for
5procedure, for appeal of agency determination, for judicial
6review and for the Office of Open Records; imposing
7penalties; providing for reporting by State-related
8institutions; requiring the posting of certain State contract
9information on the Internet; and making related repeals,"
10further providing for definitions and for exceptions for
11public records.

12The General Assembly of the Commonwealth of Pennsylvania
13hereby enacts as follows:

14Section 1. Section 102 of the act of February 14, 2008
15(P.L.6, No.3), known as the Right-to-Know Law, is amended by
16adding a definition to read:

17Section 102. Definitions.

18The following words and phrases when used in this act shall
19have the meanings given to them in this section unless the
20context clearly indicates otherwise:

22School entity." Any of the following, which shall have the

1meaning given to them in the act of March 10, 1949 (P.L.30,
2No.14), known as the Public School Code of 1949:

3(1) School district.

4(2) Intermediate unit.

5(3) Area vocational-technical school.

6(4) Charter school.

7(5) Cyber charter school.

8(6) Community college.

9(7) The State System of Higher Education.

10(8) Any school funded and administered by the Department
11of Education.

13Section 2. Section 708(b)(6) of the act is amended to read:

16(b) Exceptions.--Except as provided in subsections (c) and
17(d), the following are exempt from access by a requester under
18this act:

20(6) (i) The following personal identification
21information:

22(A) A record containing all or part of a
23person's Social Security number, driver's license
24number, personal financial information, home,
25cellular or personal telephone numbers, personal e-
26mail addresses, employee number or other confidential
27personal identification number.

28(B) A spouse's name, marital status or
29beneficiary or dependent information.

30(C) The home address of a law enforcement

1officer [or], judge or individual employed by a 
2school entity.

3(ii) Nothing in this paragraph shall preclude the
4release of the name, position, salary, actual
5compensation or other payments or expenses, employment
6contract, employment-related contract or agreement and
7length of service of a public official or an agency
8employee.

9(iii) An agency may redact the name or other
10identifying information relating to an individual
11performing an undercover or covert law enforcement
12activity from a record.

14Section 3. This act shall take effect in 60 days.
