1Amending Title 3 (Agriculture) of the Pennsylvania Consolidated
2Statutes, in food protection, further providing for
3registration of food establishments.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 5734(d) of Title 3 of the Pennsylvania 
7Consolidated Statutes, amended October 24, 2012 (P.L.1434, 
8No.180), is amended to read:

9§ 5734. Registration of food establishments.

11(d) Exceptions.--[All of the following shall be exempt from 
12the provisions of this section:] The following shall apply:

13(1) Vehicles used primarily for the transportation of
14any consumer commodity in bulk or quantity to manufacturers,
15packers, processors or wholesale or retail distributors shall 
16be exempt from the provisions of this section.

17(2) A food establishment that [is in compliance with the 
18act of July 20, 1974 (P.L.537, No.184), referred to as the 
19Honey Sale and Labeling Act, and in which 100% of the
 

1regulated products offered for human consumption are produced 
2or processed on the farm on which the food establishment is 
3located] prepares, processes, packages or sells any of the 
4following shall be exempt from the registration fee 
5requirements in subsection (c):

6(i) Honey.

7(ii) Maple syrup.

8(iii) Pasteurized cider.

9(iv) A combination of any of the foods listed in
10subparagraphs (i), (ii) and (iii).

12Section 2. This act shall take effect in 60 days.
