AN ACT

 

1Amending Title 65 (Public Officers) of the Pennsylvania
2Consolidated Statutes, further providing for definitions, for
3statement of financial interests required to be filed and for
4powers and duties of commission.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. Section 1102 of Title 65 of the Pennsylvania
8Consolidated Statutes is amended by adding a definition to read:

9§ 1102. Definitions.

10The following words and phrases when used in this chapter
11shall have, unless the context clearly indicates otherwise, the
12meanings given to them in this section:

14"Political party officer." An individual holding the office
15of chairman, vice-chairman, secretary or treasurer for a
16political party at the State or county level.

18Section 2. Section 1104(a) and (e) of Title 65 are amended

1and the section is amended by adding subsections to read:

2§ 1104. Statement of financial interests required to be filed.

3(a) Public official or public employee.--Each public
4official of the Commonwealth and political party officer shall
5file a statement of financial interests for the preceding
6calendar year with the commission no later than May 1 of each
7year that he holds such a position and of the year after he
8leaves such a position. Each public employee and public official
9of the Commonwealth shall file a statement of financial
10interests for the preceding calendar year with the department,
11agency, body or bureau in which he is employed or to which he is
12appointed or elected no later than May 1 of each year that he
13holds such a position and of the year after he leaves such a
14position. Any other public employee or public official shall
15file a statement of financial interests with the governing
16authority of the political subdivision by which he is employed
17or within which he is appointed or elected no later than May 1
18of each year that he holds such a position and of the year after
19he leaves such a position. Persons who are full-time or part-
20time solicitors for political subdivisions are required to file
21under this section.

22(a.1) Statewide official and member of the General
23Assembly.--Beginning May 1, 2015, and each May 1 thereafter, a
24Statewide official and member of the General Assembly shall file
25electronically the statement of financial interests required
26under subsection (a). The filing must be in a form and manner
27prescribed by the commission.

28(a.2) Political party officer.--Beginning May 1, 2015, and
29each May 1 thereafter, a political party officer shall make the
30required filing under subsection (a).

2(e) Public inspection and copying.--All statements of
3financial interests filed pursuant to the provisions of this
4chapter shall be [made]:

5(1) made available for public inspection and copying
6during regular office hours, and copying facilities shall be
7made available at a charge not to exceed actual cost; and

8(2) posted on the publicly accessible Internet websites 
9of the commission and other State agencies that receive and 
10file statements of financial interests.

11Section 3. Section 1107(6) and (7) of Title 65 are amended
12and the section is amended by adding paragraphs to read:

13§ 1107. Powers and duties of commission.

14In addition to other powers and duties prescribed by law, the
15commission shall:

17(6) (i) Provide that statements and reports filed with
18the commission be made available for public inspection
19and copying during regular office hours and provide that
20copying facilities be made available at a charge not to
21exceed actual cost [and advise].

22(ii) Post on its publicly accessible Internet
23website the statements of financial interests required to
24be filed with it.

25(iii) Advise other State and local agencies of the
26provisions of this paragraph.

27(7) Compile and maintain an index, including a database 
28on its publicly accessible Internet website, of all reports
29and statements filed with the commission to facilitate public
30access to such reports and statements and instruct other

1State and local agencies which receive and file financial
2interest statements in the maintenance of systems, including 
3publicly accessible Internet websites, which facilitate
4public access to such statements. The database required under 
5this paragraph shall be searchable and sortable by, at a 
6minimum, the following:

7(i) The name of the individual filing the report or
8statement.

9(ii) The office held by the individual filing the
10report or statement.

11(iii) The year the form was filed.

12(iv) Whether or not the form is an amended filing.

13The database required under this paragraph shall be
14operational no later than May 1, 2015.

15(7.1) Connect an amended filing to the original filing
16on its publicly accessible Internet website in a way that a
17person accessing one will be notified of the existence of the
18other.

19(7.2) Provide an e-mail notification option for a person
20who would like to be notified of new filings.

22Section 4. This act shall take effect in 60 days.
