AN ACT

 

1Amending the act of April 9, 1929 (P.L.343, No.176), entitled,
2as amended, "An act relating to the finances of the State
3government; providing for the settlement, assessment,
4collection, and lien of taxes, bonus, and all other accounts
5due the Commonwealth, the collection and recovery of fees and
6other money or property due or belonging to the Commonwealth,
7or any agency thereof, including escheated property and the
8proceeds of its sale, the custody and disbursement or other
9disposition of funds and securities belonging to or in the
10possession of the Commonwealth, and the settlement of claims
11against the Commonwealth, the resettlement of accounts and
12appeals to the courts, refunds of moneys erroneously paid to
13the Commonwealth, auditing the accounts of the Commonwealth
14and all agencies thereof, of all public officers collecting
15moneys payable to the Commonwealth, or any agency thereof,
16and all receipts of appropriations from the Commonwealth,
17authorizing the Commonwealth to issue tax anticipation notes
18to defray current expenses, implementing the provisions of
19section 7(a) of Article VIII of the Constitution of
20Pennsylvania authorizing and restricting the incurring of
21certain debt and imposing penalties; affecting every
22department, board, commission, and officer of the State
23government, every political subdivision of the State, and
24certain officers of such subdivisions, every person,
25association, and corporation required to pay, assess, or
26collect taxes, or to make returns or reports under the laws
27imposing taxes for State purposes, or to pay license fees or
28other moneys to the Commonwealth, or any agency thereof,
29every State depository and every debtor or creditor of the
30Commonwealth," providing for the Commonwealth Technology
31Fund.

1hereby enacts as follows:

2Section 1. Article XVII-A of the act of April 9, 1929
3(P.L.343, No.176), known as The Fiscal Code, is amended by
4adding a subarticle to read:

13SUBARTICLE A

14COMMONWEALTH TECHNOLOGY FUND

15Section 1701-P. Establishment of Commonwealth Technology Fund.

16There is hereby established a fund within the State Treasury
17to be called the Commonwealth Technology Fund.

18Section 1702-P. Transfer to Commonwealth Technology Fund.

19The Secretary of the Budget shall transfer the sum of
20$25,000,000 of proceeds from the tax imposed under Article II of
21the act of March 4, 1971 (P.L.6, No.2), known as the Tax Reform
22Code of 1971, to the Commonwealth Technology Fund by September
2330 of each year.

24Section 1703-P. Use of Commonwealth Technology Fund.

25(a) Request by Governor.--As a component to the annual
26budget submission required under section 613 of the act of April
279, 1929 (P.L.177, No.175), known as The Administrative Code of
281929, the Governor shall provide a request for utilizing the
29moneys that the Governor reasonably expects to be in the
30Commonwealth Technology Fund within the fiscal year covered by

1the budget. The request shall list the departments, agencies,
2offices or commissions and the dollar amount that each would
3receive in the upcoming fiscal year, a brief description of the
4project and an estimate of the total cost of each project if it
5is a multiyear project.

6(b) Description of project.--As part of the budget
7information submitted under section 619(d) of The Administrative
8Code of 1929 any department, agency, office or commission
9expected to receive funds under subsection (a) shall include a
10detailed description of the technology project that would be
11funded. This description shall include a detailed explanation of
12the hardware and software that will be purchased, the
13anticipated date of these purchases, the expected vendors and
14the reason that the project is necessary and the amount of any
15expected savings from the project.

16(c) Requirement for funds.--For a project to be eligible for
17funding under this subarticle the project must be for computing
18technology, such as networking, hardware, software, the Internet
19or telecommunications to process and distribute information in
20digital form.

21(d) List of projects.--The General Assembly may, in
22consultation with the Governor, amend the list of projects that
23will be funded. No funds shall be spent unless appropriated.

24Section 3. This act shall take effect in 60 days.
