AN ACT

 

1Amending the act of December 5, 1936 (2nd Sp.Sess., 1937
2P.L.2897, No.1), entitled "An act establishing a system of
3unemployment compensation to be administered by the
4Department of Labor and Industry and its existing and newly
5created agencies with personnel (with certain exceptions)
6selected on a civil service basis; requiring employers to
7keep records and make reports, and certain employers to pay
8contributions based on payrolls to provide moneys for the
9payment of compensation to certain unemployed persons;
10providing procedure and administrative details for the
11determination, payment and collection of such contributions
12and the payment of such compensation; providing for
13cooperation with the Federal Government and its agencies;
14creating certain special funds in the custody of the State
15Treasurer; and prescribing penalties," in administration of
16act, providing for incarcerated offenders.

17The General Assembly of the Commonwealth of Pennsylvania
18hereby enacts as follows:

19Section 1. The act of December 5, 1936 (2nd Sp.Sess., 1937
20P.L.2897, No.1), known as the Unemployment Compensation Law, is
21amended by adding a section to read:

22Section 207.1. Incarcerated Offenders.--The department shall
23implement, in conjunction with the Department of Corrections and
24county correctional facilities, a system whereby State and

1county corrections officials are able to conduct cross reference
2checks of incarcerated offenders by Social Security number to
3determine whether an offender is eligible for or receiving
4benefits. The department may not pay benefits for any weeks of
5unemployment during which an offender is incarcerated following
6conviction. At a minimum, cross reference checks shall be
7conducted biannually. The department shall prepare and submit
8annually to the chairman and minority chairman of the Labor and
9Industry Committee of the Senate and the chairman and minority
10chairman of the Labor and Industry Committee of the House of
11Representatives and post on its Internet website a report that
12includes the following information:

13(1) Whether any benefits were paid to incarcerated
14offenders during the preceding year.

15(2) The number of incarcerated offenders who received
16benefits during the preceding year.

17(3) Actions taken to ensure that incarcerated offenders
18do not receive benefits.

19Section 2. This act shall take effect in 60 days.
