1Amending <-Title Titles 3 (Agriculture) and 34 (Game) of the
2Pennsylvania Consolidated Statutes, <-providing for swine 
3hunting preserves; and further providing for the definition
4of "wild animals."

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

<-7Section 1. The definition of "wild animals" in section 102
8of Title 34 of the Pennsylvania Consolidated Statutes is amended
9to read:

11Consolidated Statutes is amended by adding a subchapter to read:

152390. Regulation of swine hunting preserves.

16§ 2390. Regulation of swine hunting preserves.

17(a) Promulgation.--The department shall promulgate
18regulations for swine hunting preserves consistent with section

114 of the department's General Quarantine Order on the
2Importation and Intrastate Movement of Swine, published at 39
3Pa.B. 5442 (September 19, 2009).

4(b) Time.--The department shall promulgate the regulations
5under subsection (a) within two years of the effective date of
6this subsection.

7(c) Sterilization of male swine.--On and after the effective
8date of this section, it shall be unlawful to release onto a
9swine hunting preserve a male swine that has not been
10sterilized.

11(d) Pennsylvania Game Commission.--Notwithstanding any other
12law, the Pennsylvania Game Commission shall have no authority to
13promulgate regulations on swine hunting preserves and no
14regulation promulgated under this section shall be construed to
15be governed by 34 Pa.C.S. (relating to game).

16Section 2. The definition of "wild animals" in section 102
17of Title 34 is amended to read:

18§ 102. Definitions.

19Subject to additional definitions contained in subsequent
20provisions of this title which are applicable to specific
21provisions of this title, the following words and phrases when
22used in this title shall have the meanings given to them in this
23section unless the context clearly indicates otherwise:

25"Wild animals." All mammals other than domestic animals as
26defined in 1 Pa.C.S. § 1991 (relating to definitions). The term 
27shall not include a species or variation of swine, pig or boar, 
28held in captivity.

30Section <-2 3. This act shall take effect in 60 days.
