AN ACT

 

1Amending the act of December 22, 2011 (P.L.586, No.127),
2entitled "An act providing for gas and hazardous liquids
3pipelines and for powers and duties of the Pennsylvania
4Public Utility Commission; and imposing civil penalties,"
5further providing for definitions; and providing for
6recreational use and for storm water runoff.

7The General Assembly of the Commonwealth of Pennsylvania
8hereby enacts as follows:

9Section 1. Section 102 of the act of December 22, 2011
10(P.L.586, No.127), known as the Gas and Hazardous Liquids
11Pipelines Act, is amended by adding a definition to read:

12Section 102. Definitions.

13The following words and phrases when used in this act shall
14have the meanings given to them in this section unless the
15context clearly indicates otherwise:

17"Public land." Land from any State park, State forest, State
18game land, wildlife refuge, waterfowl refuge or municipal public
19park.

2Section 2. The act is amended by adding sections to read:

3Section 702. Recreational use.

4Within counties of the first, second and third class, if a
5pipeline operator purchases or obtains an easement for public
6land, agricultural-easement land or permanently preserved land
7for new or expanded pipelines, the pipeline operator must
8purchase or grant an easement for an equivalent section of land
9within the respective county for public active or passive
10recreational use. The recreational land shall be selected and
11recreationally developed at the direction of the county. No
12other development of the recreational land may occur.

13Section 703. Storm water runoff.

14(a) Duty of pipeline operators.--Notwithstanding any law or 
15regulation to the contrary, a pipeline operator engaged in the 
16construction or replacement of pipelines involving the 
17alteration or development of land shall assure that the volume 
18and maximum rate of storm water runoff after the construction or 
19replacement does not exceed the volume and maximum rate of 
20runoff that existed prior to the construction or replacement.

21(b) Duty of of Department of Environmental Protection.--The
22Department of Environmental Protection shall verify compliance
23with this section through 25 Pa. Code Ch. 102 (relating to
24erosion and sediment control) and may promulgate regulations to
25implement this section.

26Section 2. This act shall take effect in 60 days.
