AN ACT

 

1Protecting from infringement the individual right of the
2citizens of the Commonwealth of Pennsylvania to bear arms as
3provided in section 21 of Article I of the Constitution of
4Pennsylvania.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. Findings.

8The General Assembly finds and declares that:

9(a) The Constitution of Pennsylvania, and its protections of
10the right to bear arms, predate the Constitution of the United
11States.

12(b) It is an established canon of judicial construction that
13a state constitution may not offer less protection of individual
14rights than the Constitution of the United States, but it can
15afford more protections.

16(c) Section 21 of Article I of the Constitution of
17Pennsylvania provides: "The right of the citizens to bear arms
18in defense of themselves and the State shall not be questioned."

1(d) Pennsylvania's constitutional protection of an
2individual's right to bear arms is clear and unequivocal.

3Section 2. Use of State resources to enforce Federal laws
4relating to firearms, firearm components or
5ammunition.

6(a) General rule.--Neither the Commonwealth, nor any of its
7political subdivisions, shall allow the use of any resources or
8public funds to enforce any Federal law, Executive order or
9regulation, which is enacted or promulgated after the effective
10date of this section, and which attempts to register, restrict
11or ban the ownership or purchase, whether by number or type, of
12a firearm, component of a firearm or ammunition.

13(b) Definition.--As used in this section, the term
14"resources" shall mean and include judicial buildings,
15correctional facilities, personnel and equipment.

16Section 3. Effective date.

17This act shall take effect immediately.
