AN ACT

 

1Amending Title 53 (Municipalities Generally) of the Pennsylvania
2Consolidated Statutes, in municipal police education and
3training, further providing for definitions.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. The definitions of "college," "police department"
7and "university" in section 2162 of Title 53 of the Pennsylvania
8Consolidated Statutes are amended to read:

9§ 2162. Definitions.

10The following words and phrases when used in this subchapter
11shall have the meanings given to them in this section unless the
12context clearly indicates otherwise:

14"College." A college which has a campus police department,
15as used in section 2416 of the act of April 9, 1929 (P.L.177, 
16No.175), known as The Administrative Code of 1929, certified by
17the Office of Attorney General as a criminal justice agency
18under the definition of "criminal justice agency" in 18 Pa.C.S. 

1§ 9102 (relating to definitions). [The term does not include the
2State System of Higher Education and its member institutions.]

4"Police department." Any of the following:

5(1) A public agency of a political subdivision having
6general police powers and charged with making arrests in
7connection with the enforcement of the criminal or traffic
8laws. This paragraph includes the sheriff's office in a
9county of the second class.

10(2) A campus police or university police department, as
11used in section 2416 of the act of April 9, 1929 (P.L.177, 
12No.175), known as The Administrative Code of 1929, certified 
13by the Office of Attorney General as a criminal justice 
14agency under the definition of "criminal justice agency" in 
1518 Pa.C.S. § 9102 (relating to definitions). [This paragraph 
16does not include a campus police or university police 
17department of the State System of Higher Education and its 
18member institutions.] This paragraph may include a campus 
19police or university police department of a member 
20institution of the State System of Higher Education upon 
21application to the commission and certified by the Office of 
22Attorney General.

23(3) A railroad or street railway police department 
24formed with officers commissioned under 22 Pa.C.S. Ch. 33 
25(relating to railroad and street railway police) or any prior 
26statute providing for such commissioning.

27(4) The Capitol Police.

28(5) The Harrisburg International Airport Police.

29(6) An airport authority police department.

1"University." A university which has a campus police 
2department, as used in section 2416 of the act of April 9, 1929 
3(P.L.177, No.175), known as The Administrative Code of 1929, 
4certified by the Office of Attorney General as a criminal 
5justice agency under the definition of "criminal justice agency" 
6in 18 Pa.C.S. § 9102 (relating to definitions). [The term does 
7not include the State System of Higher Education and its member 
8institutions.]

9Section 2. This act shall take effect in 60 days.
