AN ACT

 

1Amending Title 23 (Domestic Relations) of the Pennsylvania
2Consolidated Statutes, in child protective services, further
3providing for exchange of information.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Title 23 of the Pennsylvania Consolidated
7Statutes is amended by adding a section to read:

8§ 6340.1. Exchange of information.

9(a) Licensed medical practitioners.--<-A In regard to a case
10of suspected child abuse, a licensed medical practitioner
<-11reporting child abuse or a child in need of protective services
12shall provide the county agency with the following information:

13(1) Relevant medical information known to the licensed
14medical practitioner regarding the child's prior and current
15health.

16(2) Information from a subsequent examination.

17(3) Information regarding treatment of the child.

1(4) Relevant medical information regarding any other
2child in the child's household.

3(b) Parental consent.--Parental consent is not required for
4the licensed medical practitioner to provide the information
5under subsection (a).

6(c) County agency information.--<-Upon the request of a
7licensed medical practitioner <-If requested by a licensed medical
8practitioner who is either the child's primary care physician or
9a licensed medical practitioner who is providing ongoing care to
10the child, the county agency shall provide the licensed medical
11practitioner with the following:

12(1) Information regarding the condition and well-being
13of the child and the progress and outcome of an investigation
14under this chapter.

15(2) Protective services records regarding the child and
16any other child in the child's household if the information
17relates to the medical evaluation of the child.

18(3) The identity of other licensed medical practitioners
19providing medical care to the child to obtain the child's
20medical records.

21(d) County agency notification.--<-Upon initiation of an
22assessment, investigation or the provision of services by a
23county agency, the <-The county agency shall notify the licensed
24medical practitioner who is the child's primary care provider
25and other licensed medical practitioner who is providing ongoing
26care to the child of the following information:

27(1) <-The Upon initiation of an assessment, investigation
28or the provision of services by a county agency, the reason
29for the assessment, investigation or provision of protective
30services to the child.

1(2) A service plan developed for the child and the
2child's family.

<-3(3) The final status of a child abuse report following
4an investigation, whether it is indicated, founded or
5unfounded.

6Section 2. This act shall take effect<- in 60 days January 1, 
72014.
