AN ACT

 

1Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2Consolidated Statutes, in firearms and other dangerous
3articles, further providing for firearms not to be carried
4without a license and for licenses.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. Sections 6106(b)(15) and 6109(k)(1) of Title 18
8of the Pennsylvania Consolidated Statutes are amended to read:

9§ 6106. Firearms not to be carried without a license.

11(b) Exceptions.--The provisions of subsection (a) shall not
12apply to:

14(15) Any person who possesses a valid and lawfully
15issued license or permit to carry a firearm which has been
16issued under the laws of another state, regardless of whether
17a reciprocity agreement exists between the Commonwealth and
18the state under section 6109(k), provided:

1(i) The state provides a reciprocal privilege for
2individuals licensed to carry firearms under section
36109.

4(ii) The Attorney General has determined that the
5firearm laws of the state are similar to the firearm laws
6of this Commonwealth.

7(iii) In making a determination that the firearm
8laws of the state are similar to the firearm laws of this
9Commonwealth, the Attorney General shall compare only the
10provisions of section 6109(e)(1)(i) through (viii) and
11(x) through (xiv) to the prohibitions contained in the
12other state's laws. The Attorney General shall have no
13authority to utilize other conditions for comparing the
14other state's laws.

18(k) Reciprocity.--

19(1) The Attorney General shall have the power and duty
20to enter into reciprocity agreements with other states
21providing for the mutual recognition of a license to carry a
22firearm issued by the Commonwealth and a license or permit to
23carry a firearm issued by the other state. To carry out this
24duty, the Attorney General [is authorized to] may negotiate
25reciprocity agreements and grant recognition of a license or
26permit to carry a firearm issued by another state and shall 
27do so where the laws of the other state are similar to the 
28provisions of subsection (e)(1)(i) through (viii) and (x) 
29through (xiv).

1Section 2. This act shall take effect in 60 days.
