AN ACT

 

1Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2Consolidated Statutes, in firearms and other dangerous
3articles, further providing for firearms not to be carried
4without a license.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. Section 6106(a) and (b)(11) and (15) of Title 18
8of the Pennsylvania Consolidated Statutes are amended to read:

9§ 6106. Firearms not to be carried without a license.

10(a) Offense defined.--

11(1) Except as provided in paragraph (2), any person who
12carries a firearm in any vehicle or any person who carries a
13firearm concealed on or about his person, except in his place
14of abode or fixed place of business, without a valid and
15lawfully issued license under this chapter commits a felony
16of the third degree.

17(2) A person who is otherwise eligible to possess a
18valid license under this chapter but carries a firearm in any
19vehicle or any person who carries a firearm concealed on or

1about his person, except in his place of abode or fixed place
2of business, without a valid and lawfully issued license and
3has not committed any other criminal violation commits a
4misdemeanor of the [first] third degree.

5(b) Exceptions.--The provisions of subsection (a) shall not
6apply to:

8(11) Any [person while carrying a firearm in any
9vehicle, which person] nonresident who possesses a valid and
10lawfully issued license [for that] to carry a concealed 
11firearm for any purpose which has been issued under the laws
12of the United States or any other state, regardless of the 
13state of residence.

15[(15) Any person who possesses a valid and lawfully
16issued license or permit to carry a firearm which has been
17issued under the laws of another state, regardless of whether
18a reciprocity agreement exists between the Commonwealth and
19the state under section 6109(k), provided:

20(i) The state provides a reciprocal privilege for
21individuals licensed to carry firearms under section
226109.

23(ii) The Attorney General has determined that the
24firearm laws of the state are similar to the firearm laws
25of this Commonwealth.]
