AN ACT

 

1Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2act relating to the public school system, including certain
3provisions applicable as well to private and parochial
4schools; amending, revising, consolidating and changing the
5laws relating thereto," establishing the Local Effort
6Equalization Fund supplement.

7The General Assembly of the Commonwealth of Pennsylvania
8hereby enacts as follows:

9Section 1. The act of March 10, 1949 (P.L.30, No.14), known
10as the Public School Code of 1949, is amended by adding a
11section to read:

12Section 2502.53.  Local Effort Equalization Fund
13Supplement.--(a) The Local Effort Equalization Fund supplement
14is established to provide assistance to school districts that
15receive less than thirty-five percent (35%) of their total
16funding from the Commonwealth.

17(b) (1) Beginning with fiscal year 2014-2015, and in each
18fiscal year thereafter, the General Assembly shall appropriate
19to the fund two hundred fifty million dollars ($250,000,000)

1annually from the General Fund to the extent funds are available
2under paragraph (2).

3(2) Notwithstanding any provision of law to the contrary,
4beginning July 1, 2014, and continuing thereafter, each week,
5one hundred percent (100%) of the moneys in the Pennsylvania
6Race Horse Development Fund established under section 1722-A.1
7of the act of April 9, 1929 (P.L.343, No.176), known as "The
8Fiscal Code," up to two hundred fifty million dollars
9($250,000,000) for any one fiscal year, shall be transferred to
10the General Fund for purposes of this section.

11(c) Beginning in the 2014-2015 school year, and in each
12school year thereafter, all moneys in the fund shall be
13distributed annually to each LEEF school district on a pro rata
14basis, based upon the average daily membership of the school
15district multiplied by the equalized mills for the school
16district using data from the second preceding school year as
17certified by the Department of Education.

18(d) (1) Beginning in the 2015-2016 school year, and in each
19school year thereafter, following application of the index under
20the act of June 27, 2006 (1st Sp.Sess., P.L.1873, No.1), known
21as the "Taxpayer Relief Act," for the school district budget for
22the subsequent school year, each LEEF school district shall
23reduce its property tax millage rate by an amount that would
24yield property tax revenue equal to the amount of LEEF
25supplement funding the school district received in the
26immediately preceding school year.

27(2) Beginning in the 2015-2016 school year, and in each
28school year thereafter, each LEEF school district shall include
29with all property tax bills a statement to each property
30taxpayer indicating the dollar amount by which the taxpayer's

1property taxes were reduced as a result of the school district's
2receipt of LEEF supplement funding in the immediately preceding
3school year.

4(e) For purposes of this section, the following words and
5phrases shall have the meanings given to them in this
6subsection:

7"LEEF school district."  A school district that received less
8than thirty-five percent (35%) of its total funding from the
9Commonwealth for the second preceding school year.

10"LEEF supplement." The Local Effort Equalization Fund
11supplement established and distributed pursuant to this section.

12"Local Effort Equalization Fund" or "Fund." The Local Effort
13Equalization Fund established in this section.

14Section 2. This act shall take effect in 60 days.
