1Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2Consolidated Statutes, further providing for the offense of
3robbery.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 3701(b) of Title 18 of the Pennsylvania
7Consolidated Statutes is amended by adding a paragraph to read:

8§ 3701. Robbery.

10(b) Grading.--

12(3) The following shall apply:

13(i) The Pennsylvania Commission on Sentencing,
14pursuant to 42 Pa.C.S. § 2154 (relating to adoption of
15guidelines for sentencing), shall provide for a
16sentencing enhancement if during the commission of the
17offense under this section or immediate flight therefrom,

1the actor knowingly concealed or attempted to conceal all
2or part of the actor's face in order to hide the actor's
3identity from any individual.

4(ii) The provisions of this paragraph shall not be
5an element of the crime, and notice of the provisions of
6this paragraph shall not be required prior to conviction.
7Reasonable notice of the Commonwealth's intention to
8proceed using the sentencing enhancement provided for
9under this paragraph shall be provided after conviction
10and before sentencing.

11Section 2. This act shall take effect in 60 days.
