AN ACT

 

1Amending Titles 30 (Fish) and 34 (Game) of the Pennsylvania
2Consolidated Statutes, in enforcement, further providing for
3definitions and for interference with lawful fishing and
4boating; and, in hunting and furtaking, further providing for
5definitions and for interference with lawful taking of
6wildlife or other activities.

7The General Assembly of the Commonwealth of Pennsylvania
8hereby enacts as follows:

9Section 1. Section 102 of Title 30 of the Pennsylvania
10Consolidated Statutes is amended by adding a definition to read:

11§ 102. Definitions.

12Subject to additional definitions contained in subsequent
13provisions of this title which are applicable to specific
14provisions of this title, the following words and phrases when
15used in this title shall have, unless the context clearly
16indicates otherwise, the meanings given to them in this section:

18"Drone." An aerial vehicle that does not carry a human
19operator.

1Section 2. Section 909(b) of Title 30 is amended by adding a
2paragraph to read:

3§ 909. Interference with lawful fishing and boating prohibited.

5(b) Activities that violate section.--A person violates this
6section if that person intentionally or knowingly commits any of
7the following:

9(7) Uses a drone in a way that interferes with another
10person who is engaged in the process of lawful fishing or
11boating.

13Section 3. Section 102 of Title 34 is amended by adding a
14definition to read:

15§ 102. Definitions.

16Subject to additional definitions contained in subsequent
17provisions of this title which are applicable to specific
18provisions of this title, the following words and phrases when
19used in this title shall have the meanings given to them in this
20section unless the context clearly indicates otherwise:

22"Drone." An aerial vehicle that does not carry a human
23operator.

25Section 4. Section 2302(a.1) of Title 34 is amended to read:

26§ 2302. Interference with lawful taking of wildlife or other
27activities permitted by this title prohibited.

29(a.1) Activities which violate section.--A person violates
30this section when he intentionally or knowingly:

1(1) drives or disturbs wildlife for the purpose of
2disrupting the lawful taking of wildlife where another person
3is engaged in the process of lawfully taking wildlife or
4other permitted activities;

5(2) blocks, impedes or otherwise harasses another person
6who is engaged in the process of lawfully taking wildlife or
7other permitted activities;

8(3) uses natural or artificial visual, aural, olfactory
9or physical stimuli to affect wildlife behavior in order to
10hinder or prevent the lawful taking of wildlife or other
11permitted activities;

12(4) creates or erects barriers with the intent to deny
13ingress or egress to areas where the lawful taking of
14wildlife or other permitted activities may occur;

15(5) interjects himself into the line of fire;

16(6) affects the condition or placement of personal or
17public property intended for use in the lawful taking of
18wildlife or other permitted activities in order to impair its
19usefulness or prevent its use;

20(7) enters or remains upon public lands or upon private
21lands without permission of the owner or their agent, with
22intent to violate this section; [or]

23(8) fails to obey the order of any officer whose duty it
24is to enforce any of the laws of this Commonwealth where such
25officer observes any conduct which violates this section or
26has reasonable grounds to believe that any person intends to
27engage in such conduct[.]; or

28(9) uses a drone in a way that interferes with another 
29person who is engaged in the process of lawfully taking 
30wildlife or other permitted activities.

2Section 5. This act shall take effect in 60 days.
