1Amending Title 42 (Judiciary and Judicial Procedure) of the
2Pennsylvania Consolidated Statutes, in particular rights and
3immunities, providing for liability relating to accidental
4delivery of heating oil to residential dwelling.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. Title 42 of the Pennsylvania Consolidated
8Statutes is amended by adding a section to read:

9§ 8321.1. Accidental delivery of heating oil to residential
10dwelling.

11An owner of a residential dwelling who sustains property
12damage to the residential dwelling as a result of the delivery
13by a person of heating oil to the residential dwelling when the
14delivery was not requested by the owner, regardless of whether
15or not a fill pipe for heating oil was capped at the residential
16dwelling, may, in a civil action in any court of competent
17jurisdiction, obtain appropriate relief from such person,
18including loss of use of the residential dwelling, loss of fair

1market value of the residential dwelling, incidental expenses,
2reasonable attorney fees and other costs associated with the
3litigation of the action.

4Section 2. This act shall take effect in 60 days.
