AN ACT
1Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2Consolidated Statutes, in offenses against public order and
3decency, further providing for gambling devices, gambling,
4etc.
5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:
7Section 1. Section 5513(e) of Title 18 of the Pennsylvania
8Consolidated Statutes is amended and the section is amended by
9adding a subsection to read:
10§ 5513. Gambling devices, gambling, etc.

12(a.2) Internet gambling.--A person commits a summary offense
13if he or she solicits, invites, collects or accepts cash, credit
14or another form of currency or a payment through a payment
15network for the purposes of wagering or betting through the
16Internet or an online service, on a game that simulates a casino
17style game or a game allowed under the following:
18(1) A game regulated by the Pennsylvania Gaming Control
1Board under 4 Pa.C.S. Part II (relating to gaming).
2(2) A lottery game of the Pennsylvania State Lottery as
3authorized under the act of August 26, 1971 (P.L.351, No.91),
4known as the State Lottery Law.
5(3) Bingo as authorized under the act of July 10, 1981
6(P.L.214, No.67), known as the Bingo Law.
7(4) Pari-mutuel betting on the outcome of thoroughbred
8or harness horse racing as authorized under the act of
9December 17, 1981 (P.L.435, No.135), known as the Race Horse
10Industry Reform Act.
11(5) A small game of chance as authorized under the act
12of December 19, 1988 (P.L.1262, No.156), known as the Local
13Option Small Games of Chance Act.

15(e) Penalty.--
16(1) Any person who fails to provide records as provided
17in subsection (d) commits a summary offense.
18(2) A second offense or subsequent offense under
19subsection (a.2) shall be considered a misdemeanor of the
20third degree.

22Section 2. This act shall take effect in 60 days.
