AN ACT

 

1Amending the act of May 29, 1945 (P.L.1134, No.405), entitled
2"An act to create a commission to act jointly with
3commissions appointed for like purpose by the States of West
4Virginia and Maryland, the Commonwealth of Virginia and the
5District of Columbia, which, together with three members to
6be appointed by the President of the United States, shall
7constitute the Interstate Commission on the Potomac River
8Basin, with power to cooperate in the abatement of the
9existing pollution, and in the control of future pollution of
10the waters of the drainage basin of the Potomac River within
11the States of Maryland and West Virginia, the Commonwealth of
12Virginia and the District of Columbia; to authorize the
13Governor of the State to execute on behalf of this State a
14compact with representatives of other states for the purpose
15of forming the above-mentioned commission; and creating a
16Potomac Valley Conservancy District; providing for the
17appointment of the Pennsylvania members of said commission
18for the Commonwealth of Pennsylvania, and their terms of
19office; and providing an appropriation," further providing
20for membership of commission and for appointments.

21The General Assembly of the Commonwealth of Pennsylvania
22hereby enacts as follows:

23Section 1. Sections 1 first paragraph and 1.1 of the act of
24May 29, 1945 (P.L.1134, No.405), entitled "An act to create a
25commission to act jointly with commissions appointed for like
26purpose by the States of West Virginia and Maryland, the

1Commonwealth of Virginia and the District of Columbia, which,
2together with three members to be appointed by the President of
3the United States, shall constitute the Interstate Commission on
4the Potomac River Basin, with power to cooperate in the
5abatement of the existing pollution, and in the control of
6future pollution of the waters of the drainage basin of the
7Potomac River within the States of Maryland and West Virginia,
8the Commonwealth of Virginia and the District of Columbia; to
9authorize the Governor of the State to execute on behalf of this
10State a compact with representatives of other states for the
11purpose of forming the above-mentioned commission; and creating
12a Potomac Valley Conservancy District; providing for the
13appointment of the Pennsylvania members of said commission for
14the Commonwealth of Pennsylvania, and their terms of office; and
15providing an appropriation," amended May 27, 1994 (P.L.255,
16No.40), are amended to read:

17Section 1. There is hereby created a commission consisting
18of three members, to act jointly with commissions appointed for
19like purposes by the States of West Virginia and Maryland, the
20Commonwealth of Virginia and the District of Columbia, and an
21additional three members to be appointed by the President of the
22United States and which, together with the other commissions
23appointed as hereinbefore mentioned, shall constitute and be
24known as the Interstate Commission on the Potomac River Basin.
25The said commission for the Commonwealth of Pennsylvania shall
26consist of three members. The Governor shall appoint two
27members, one of whom shall be a member of the public
28knowledgeable in matters involving water pollution and the other
29shall be a member of the General Assembly of the Commonwealth of
30Pennsylvania or his designee. The third member shall be the

1Secretary of Environmental Resources or his designee. The
2appointed members shall serve for terms of two years or until
3their successors are appointed. The Secretary of Environmental
4Resources or his designee shall serve for the same period as his
5tenure as Secretary of Environmental Resources. They shall serve
6without compensation, but shall be paid their actual expenses
7incurred in and incident to the performance of their duties as
8hereinafter set forth. The Commonwealth shall contribute to the
9Interstate Commission on the Potomac River Basin its pro rata
10share of the expenses of said commission which shall be such
11sums as may be appropriated for the purpose, but not less than
12the sum of one thousand two hundred dollars ($1,200) per year
13for the biennium beginning June first, one thousand nine hundred
14and forty-five.

16Section 1.1. The Governor of the Commonwealth of
17Pennsylvania shall appoint an alternate member for each of the
18two appointed members of the commission for the Commonwealth of
19Pennsylvania created by section 1 of the act of May 29, 1945
20(P.L.1134). Each such alternate shall be appointed from among
21the members of the General Assembly, or a designee, or the
22public, as the case may be. The Secretary of Environmental
23Resources shall also appoint an alternate. Each such alternate
24shall have the power to act in the absence of the person for
25whom he is an alternate. The term of each alternate shall run
26concurrently with the term of the member for whom he is an
27alternate.

28Section 2. This act shall take effect in 60 days.
