AN ACT

 

1Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2Consolidated Statutes, further providing for criminal
3homicide of law enforcement officer and for police animals.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 2507(e) of Title 18 of the Pennsylvania
7Consolidated Statutes is amended and the section is amended by
8adding a subsection to read:

9§ 2507. Criminal homicide of law enforcement officer.

11(d.1) Restitution.--In any case in which a defendant is
12convicted of killing a police animal in violation of subsection
13(a), (b), (c) or (d), the defendant shall be ordered to make
14restitution to the agency or individual owning the animal for
15replacement costs of the animal and for the salary of the
16animal's handler for the period of time the handler's services

1are lost to the agency.

2(e) Definitions.--As used in this section, the following
3words and phrases shall have the meanings given to them in this
4subsection:

5"Law enforcement officer." This term shall have the same
6meaning as the term "peace officer" is given under section 501
7(relating to definitions) and shall include "police animal" as 
8defined in section 5511.2 (relating to police animals).

9"Perpetration of a felony." As defined under section 2502(d)
10(relating to murder).

11Section 2. Section 5511.2(b) and (c) of Title 18 are amended
12to read:

13§ 5511.2. Police animals.

15(b) Illegal to torture police animals.--It shall be unlawful
16for any person to willfully or maliciously torture, mutilate,
17injure, disable[,]or poison [or kill] a police animal. Any
18person who violates any of the provisions of this subsection
19commits a felony of the third degree.

20(c) Restitution.--In any case in which a defendant is
21convicted of a violation of subsection (a) or (b), the defendant
22shall be ordered to make restitution to the agency or individual
23owning the animal for any veterinary bills, for replacement
24costs of the animal if it is disabled [or killed] and for the
25salary of the animal's handler for the period of time the
26handler's services are lost to the agency.

28Section 3. This act shall take effect in 60 days.
