AN ACT

 

1Amending the act of July 23, 1970 (P.L.563, No.195), entitled
2"An act establishing rights in public employes to organize
3and bargain collectively through selected representatives;
4defining public employes to include employes of nonprofit
5organizations and institutions; providing compulsory
6mediation and fact-finding, for collective bargaining
7impasses; providing arbitration for certain public employes
8for collective bargaining impasses; defining the scope of
9collective bargaining; establishing unfair employe and
10employer practices; prohibiting strikes for certain public
11employes; permitting strikes under limited conditions;
12providing penalties for violations; and establishing
13procedures for implementation," in employee organizations,
14further providing for prohibited political contributions;
15and, in penalties, further providing for interfering with a
16board member.

17The General Assembly of the Commonwealth of Pennsylvania
18hereby enacts as follows:

19Section 1. Sections 1701 and 1901 of the act of July 23,
201970 (P.L.563, No.195), known as the Public Employe Relations
21Act, are amended to read:

22Section 1701. No employe organization shall make any
23contribution out of the funds of the employe organization either
24directly or indirectly to any political party or organization or

1in support of any political candidate for public office.

2The board shall establish such rules and regulations as it
3may find necessary to prevent the circumvention or evasion of
4the provisions of this section.

5If an employe organization has made contributions in
6violation of this section it shall file with the board a report
7or affidavit evidencing such contributions within ninety days of
8the end of its fiscal year. Such report or affidavit shall be
9signed by its president and treasurer or corresponding
10principals.

11Any employe organization which violates the provisions of
12this section or fails to file any required report or affidavit
13or files a false report or affidavit shall be subject to a fine
14of not more than [two thousand dollars ($2,000)] four thousand 
15dollars ($4,000).

16Any person who wilfully violates this section, or who makes a
17false statement knowing it to be false, or who knowingly fails
18to disclose a material fact shall be fined not more than [one
19thousand dollars ($1,000)] two thousand dollars ($2,000) or
20imprisoned for not more than thirty days or both. Each
21individual required to sign affidavits or reports under this
22section shall be personally responsible for filing such report
23or affidavit and for any statement contained therein he knows to
24be false.

25Nothing herein shall be deemed to prohibit voluntary
26contributions by individuals to political parties or candidates.

27Section 1901. Any person who shall wilfully resist, prevent,
28impede or interfere with any member of the board, or any of its
29agents, in the performance of duties pursuant to this act, shall
30be guilty of a misdemeanor, and, upon conviction thereof, shall

1be sentenced to pay a fine of not more than [five thousand
2dollars ($5,000)] ten thousand dollars ($10,000), or by
3imprisonment for not more than one year, or both.

4Section 2. This act shall take effect immediately.
