AN ACT
1Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2Consolidated Statutes, in trade and commerce, prohibiting the
3sale of certain laser pointers; and prescribing a penalty.
4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:
6Section 1. Title 18 of the Pennsylvania Consolidated
7Statutes is amended by adding a section to read:
8§ 7332. Sale of laser pointers.
9(a) Offense defined.--No person shall sell or offer to sell
10a laser pointer.
11(b) Grading.--A person who violates this section commits a
12summary offense and, upon conviction thereof, shall be sentenced
13to pay a fine in an amount not to exceed $500 for a first
14offense and not to exceed $1,000 for a second or subsequent
15offense.
16(c) Nonapplicability.--This section shall not apply to a
17laser pointer that is:
18(1) affixed to a firearm, as defined in section 6102
1(relating to definitions); or
2(2) used by or under the supervision of a health care
3practitioner licensed under the laws of this Commonwealth.
4(d) Definition.--For purposes of this section, a "laser
5pointer" is a device that:
6(1) emits laser light to project a beam that may be used
7for aiming, targeting or pointing out features of an object;
8and
9(2) exceeds one milliwatt in output power.
10Section 2. This act shall take effect in 60 days.
