AN ACT

 

1Amending Title 42 (Judiciary and Judicial Procedure) of the
2Pennsylvania Consolidated Statutes, providing for a duty to
3assist victims of personal injury crimes.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 8331.3 of Title 42 of the Pennsylvania
7Consolidated Statutes is amended to read:

8§ 8331.3. Criminal victim aid good Samaritan civil immunity.

9(a) [General rule.--] Duty to assist.--The following shall 
10apply:

11(1) A person at the scene of a personal injury crime or
12attempted personal injury crime who knows that another person
13is exposed to or has suffered grave physical harm shall, to
14the extent that the person can do so without danger or peril
15to self or others, give reasonable assistance to the victim.
16Reasonable assistance includes, but is not limited to,
17obtaining or attempting to obtain aid from law enforcement or
18medical personnel.

19(2) A person who violates this subsection commits a

1summary offense.

2(a.1) Immunity.--Any person who provides or obtains or
3attempts to provide or obtain reasonable assistance for a victim
4of a personal injury crime at the scene of the personal injury
5crime or attempted personal injury crime shall not be liable for
6any civil damages as a result of any acts or omissions in
7providing or obtaining or attempting to provide or obtain
8reasonable assistance, except any acts or omissions
9intentionally designed to harm or any acts or omissions that
10constitute gross negligence or willful, wanton or reckless
11conduct.

12(b) Definitions.--The terms "personal injury crime" and
13"victim" shall have the same meanings given to them in section
14103 of the act of November 24, 1998 (P.L.882, No.111), known as
15the Crime Victims Act.

16Section 2. This act shall take effect in 60 days.
