AN ACT

 

1To provide from the General Fund for the expenses of the
2Executive and Judicial Departments, the State Government
3Support Agencies and the General Assembly of the
4Commonwealth, the public debt and the public schools for the
5fiscal year July 1, 2013, to June 30, 2014, for certain
6institutions and organizations, and for the payment of bills
7incurred and remaining unpaid at the close of the fiscal year
8ending June 30, 2013; to provide appropriations from the
9State Lottery Fund, the Tobacco Settlement Fund, the Aviation
10Restricted Account, the Hazardous Material Response Fund, The
11State Stores Fund, the Milk Marketing Fund, the Home
12Investment Trust Fund, the Emergency Medical Services
13Operating Fund, the Tuition Account Guaranteed Savings
14Program Fund, the Banking Fund, the Firearm Records Check
15Fund, the Ben Franklin Technology Development Authority Fund,
16the Oil and Gas Lease Fund, the Home Improvement Account, the
17Cigarette Fire Safety and Firefighter Protection Act
18Enforcement Fund and the Energy Conservation and Assistance
19Fund, to the Executive Department; to provide appropriations
20from the Judicial Computer System Augmentation Account to the
21Judicial Department for the fiscal year July 1, 2013, to June
2230, 2014; to provide appropriations from the Motor License
23Fund for the fiscal year July 1, 2013, to June 30, 2014, for
24the proper operation of several departments of the

7The General Assembly of the Commonwealth of Pennsylvania
8hereby enacts as follows:

9PART I

10GENERAL PROVISIONS

11Section 101. Short title.

12This act shall be known and may be cited as the General
13Appropriation Act of 2013.

14Section 102. Definitions.

15The following words and phrases when used in this act shall
16have the meanings given to them in this section unless the
17context clearly indicates otherwise:

18"Employees." Includes all directors, superintendents, bureau
19or division chiefs, assistant directors, assistant
20superintendents, assistant chiefs, experts, scientists,
21engineers, surveyors, draftsmen, accountants, secretaries,
22auditors, inspectors, examiners, analysts, statisticians,
23marshals, clerks, stenographers, bookkeepers, messengers and
24other assistants in any department, board or commission.

25"Expenses" and "maintenance." Includes all printing, binding
26and stationery, food and forage, materials and supplies,
27traveling expenses, training, motor vehicle supplies and
28repairs, freight, express and cartage, postage, telephones and
29telegraph rentals and toll charges, newspaper advertising and
30notices, public advertising by or through any medium, fuel,

1light, heat, power and water, minor construction and renovation,
2repairs or reconstruction of equipment, buildings and
3facilities, rent of real estate and equipment, premiums on
4workers' compensation, insurance premiums on policies of
5liability insurance, insurance premiums on medical payment
6insurance and surety bonds for volunteer workers, premiums on
7employee group life insurance and employee and retired employee
8group hospital and medical insurance, payment of Commonwealth
9share of Social Security taxes and unemployment compensation
10costs for State employees, the purchase of replacement or
11additional equipment and machinery and all other incidental
12costs and expenses, including payment to the Department of
13General Services of mileage and other charges for the use of
14automobiles and rental payments for permanently assigned
15automobiles and of expenses or costs of services incurred
16through the Purchasing Fund. The term "expenses" also shall
17include the medical costs for the treatment of inmates of State
18institutions when the inmate must be transferred to an outside
19hospital, provided, that in no case shall the State institution
20pay more for patient care than that provided under the State
21medical assistance program.

22Section 103. Abbreviations.

23The following abbreviations when used in this act shall have
24the meanings given to them in this section unless the context
25clearly indicates otherwise:

2Section 104. State appropriations.

3(a) General Fund.--The following sums set forth in this act,
4or as much thereof as may be necessary, are hereby specifically
5appropriated from the General Fund to the several hereinafter
6named agencies of the Executive, Legislative and Judicial
7Departments of the Commonwealth for the payment of salaries,
8wages or other compensation and travel expenses of the duly
9elected or appointed officers and employees of the Commonwealth,
10for the payment of fees for contractual services rendered, for
11the purchase or rental of goods and services, printing, public
12advertising by or through any medium, equipment, land and
13buildings and for payment of any other expenses, as provided by
14law or by this act, necessary for the proper conduct of the
15duties, functions and activities and for the purposes
16hereinafter set forth for the fiscal year beginning July 1,
172013, and for the payment of bills incurred and remaining unpaid
18at the close of the fiscal year ending June 30, 2013.

19(b) State Lottery Fund.--The following sums set forth in
20this act, or as much thereof as may be necessary, are hereby
21specifically appropriated from the State Lottery Fund to the
22several hereinafter named agencies of the Executive Department
23of the Commonwealth for the payment of salaries, wages or other
24compensation and travel expenses of the duly appointed officers
25and employees of the Commonwealth, for the payment of fees for
26contractual services rendered, for the purchase or rental of
27goods and services and for payment of any other expenses, as
28provided by law or by this act, necessary for the proper conduct
29of the duties, functions and activities and for the purposes
30hereinafter set forth for the fiscal year beginning July 1,

12013, and for the payment of bills incurred and remaining unpaid
2at the close of the fiscal year ending June 30, 2013.

3(c) Tobacco Settlement Fund.--The following sums set forth
4in this act, or as much thereof as may be necessary, are hereby
5specifically appropriated from the Tobacco Settlement Fund to
6the hereinafter named agencies of the Executive Department of
7the Commonwealth for the payment of salaries, wages or other
8compensation and travel expenses of the duly appointed officers
9and employees of the Commonwealth, for the payment of fees for
10contractual services rendered, for the purchase or rental of
11goods and services and for payment of any other expenses, as
12provided by law or by this act, necessary for the proper conduct
13of the duties, functions and activities and for the purposes
14hereinafter set forth for the fiscal year beginning July 1,
152013, and for the payment of bills incurred and remaining unpaid
16at the close of the fiscal year ending June 30, 2013.

17(d) Judicial Computer System Augmentation Account.--The
18following sums set forth in this act, or as much thereof as may
19be necessary, are hereby specifically appropriated from the
20restricted receipt account established within the General Fund,
21known as the Judicial Computer System Augmentation Account, to
22the Judicial Department of the Commonwealth for the payment of
23salaries, wages or other compensation and travel expenses, for
24the payment of fees for contractual services rendered, for the
25purchase or rental of goods and services and for the payment of
26any other expenses, as provided by law or by this act, necessary
27for the proper conduct of the duties, functions and activities
28and for the purposes hereinafter set forth for the fiscal year
29beginning July 1, 2013, and for the payment of bills incurred
30and remaining unpaid at the close of the fiscal year ending June

130, 2013.

2(e) Emergency Medical Services Operating Fund.--The
3following sums set forth in this act, or as much thereof as may
4be necessary, are hereby specifically appropriated from the
5Emergency Medical Services Operating Fund to the several
6hereinafter named agencies of the Executive Department of the
7Commonwealth for the payment of fees for contractual services
8rendered, for the purchase or rental of goods and services and
9for the payment of any other expenses, as provided by law or by
10this act, necessary for the proper conduct of the duties,
11functions and activities and for the purposes hereinafter set
12forth for the fiscal year beginning July 1, 2013, and for the
13payment of bills incurred and remaining unpaid at the close of
14the fiscal year ending June 30, 2013.

15(f) The State Stores Fund.--The following sums set forth in
16this act, or as much thereof as may be necessary, are hereby
17specifically appropriated from The State Stores Fund to the
18hereinafter named agency of the Executive Department of the
19Commonwealth for the payment of salaries, wages or other
20compensation and travel expenses of the duly appointed officers
21and employees of the Commonwealth, for the payment of fees for
22contractual services rendered, for the purchase or rental of
23goods and services and for the payment of any other expenses, as
24provided by law or by this act, necessary for the proper conduct
25of the duties, functions and activities and for the purposes
26hereinafter set forth for the fiscal year beginning July 1,
272013, and for the payment of bills incurred and remaining unpaid
28at the close of the fiscal year ending June 30, 2013.

29(g) Motor License Fund.--The following sums, or as much
30thereof as may be necessary, are hereby appropriated from the

1Motor License Fund to the hereinafter named agencies of the
2Executive Department for the payment of salaries, wages and
3other compensation and travel expenses of the duly elected or
4appointed officers and employees of the Commonwealth, for
5contractual services and other expenses necessary for the proper
6conduct of the duties, functions and activities for the purposes
7hereinafter set forth for the fiscal year beginning July 1,
82013, and for the payment of bills incurred and remaining unpaid
9at the close of the fiscal year ending June 30, 2013.

10(h) Aviation Restricted Account.--The following sums, or as
11much thereof as may be necessary, are hereby appropriated from
12the Aviation Restricted Account in the Motor License Fund to the
13hereinafter named agencies of the Executive Department for the
14purposes set forth herein for the fiscal year beginning July 1,
152013, and for the payment of bills incurred and remaining unpaid
16at the close of the fiscal year ending June 30, 2013.

17(i) Hazardous Material Response Fund.--The following sums
18set forth in this act, or as much thereof as may be necessary,
19are hereby specifically appropriated from the Hazardous Material
20Response Fund to the several hereinafter named agencies of the
21Executive Department of the Commonwealth for the payment of fees
22for contractual services rendered, for the purchase or rental of
23goods and services and for the payment of any other expenses, as
24provided by law or by this act, necessary for the proper conduct
25of the duties, functions and activities and for the purposes
26hereinafter set forth for the fiscal year beginning July 1,
272013, and for the payment of bills incurred and remaining unpaid
28at the close of the fiscal year ending June 30, 2013.

29(j) Milk Marketing Fund.--The following sums set forth in
30this act, or as much thereof as may be necessary, are hereby

1specifically appropriated from the Milk Marketing Fund to the
2several hereinafter named agencies of the Executive Department
3of the Commonwealth for the payment of salaries, wages or other
4compensation and travel expenses of the duly appointed officers
5and employees of the Commonwealth, for the payment of fees for
6contractual services rendered, for the purchase or rental of
7goods and services and for the payment of any other expenses, as
8provided by law or by this act, necessary for the proper conduct
9of the duties, functions and activities and for the purposes
10hereinafter set forth for the fiscal year beginning July 1,
112013, and for the payment of bills incurred and remaining unpaid
12at the close of the fiscal year ending June 30, 2013.

13(k) Home Investment Trust Fund.--The following sums set
14forth in this act, or as much thereof as may be necessary, are
15hereby specifically appropriated from the Home Investment Trust
16Fund to the hereinafter named agencies of the Executive
17Department of the Commonwealth for the payment of salaries,
18wages or other compensation and travel expenses of the duly
19appointed officers and employees of the Commonwealth, for the
20payment of fees for contractual services rendered, for the
21purchase or rental of goods and services and for the payment of
22any other expenses, as provided by law or by this act, necessary
23for the proper conduct of the duties, functions and activities
24and for the purposes hereinafter set forth for the fiscal year
25beginning July 1, 2013, and for the payment of bills incurred
26and remaining unpaid at the close of the fiscal year ending June
2730, 2013.

28(l) Tuition Account Guaranteed Savings Program Fund.--The
29following sums set forth in this act, or as much thereof as may
30be necessary, are hereby specifically appropriated from the

1Tuition Account Guaranteed Savings Program Fund to the
2hereinafter named agencies of the Executive Department of the
3Commonwealth for the payment of salaries, wages or other
4compensation and travel expenses of the duly appointed officers
5and employees of the Commonwealth, for the payment of fees for
6contractual services rendered, for the purchase or rental of
7goods and services and for the payment of any other expenses, as
8provided by law or by this act, necessary for the proper conduct
9of the duties, functions and activities and for the purposes
10hereinafter set forth for the fiscal year beginning July 1,
112013, and for the payment of bills incurred and remaining unpaid
12at the close of the fiscal year ending June 30, 2013.

13(m) Banking Fund.--The following sums set forth in this act,
14or as much thereof as may be necessary, are hereby specifically
15appropriated from the Banking Fund to the hereinafter named
16agencies of the Executive Department of the Commonwealth for the
17payment of salaries, wages or other compensation and travel
18expenses of the duly appointed officers and employees of the
19Commonwealth, for the payment of fees for contractual services
20rendered, for the purchase or rental of goods and services and
21for the payment of any other expenses, as provided by law or by
22this act, necessary for the proper conduct of the duties,
23functions and activities and for the purposes hereinafter set
24forth for the fiscal year beginning July 1, 2013, and for the
25payment of bills incurred and remaining unpaid at the close of
26the fiscal year ending June 30, 2013.

27(n) Firearm Records Check Fund.--The following sums set
28forth in this act, or as much thereof as may be necessary, are
29hereby specifically appropriated from the Firearm Records Check
30Fund to the hereinafter named agencies of the Executive

1Department of the Commonwealth for the payment of salaries,
2wages or other compensation and travel expenses of the duly
3appointed officers and employees of the Commonwealth, for the
4payment of fees for contractual services rendered, for the
5purchase or rental of goods and services and for the payment of
6any other expenses, as provided by law or by this act, necessary
7for the proper conduct of the duties, functions and activities
8and for the purposes hereinafter set forth for the fiscal year
9beginning July 1, 2013, and for the payment of bills incurred
10and remaining unpaid at the close of the fiscal year ending June
1130, 2013.

12(o) Ben Franklin Technology Development Authority Fund.--The
13following sums set forth in this act, or as much thereof as may
14be necessary, are hereby specifically appropriated from the Ben
15Franklin Technology Development Authority Fund to the
16hereinafter named agencies of the Executive Department of the
17Commonwealth for the payment of salaries, wages or other
18compensation and travel expenses of the duly appointed officers
19and employees of the Commonwealth, for the payment of fees for
20contractual services rendered, for the purchase or rental of
21goods and services and for the payment of any other expenses, as
22provided by law or by this act, necessary for the proper conduct
23of the duties, functions and activities and for the purposes
24hereinafter set forth for the fiscal year beginning July 1,
252013, and for the payment of bills incurred and remaining unpaid

27(p) Oil and Gas Lease Fund.--The following sums set forth in

25Section 105. Federal augmentation appropriations.

26The following Federal augmentation appropriations set forth

7Section 106. Block grants.

8(a) Appropriation.--The following sums set forth in this
9act, or as much thereof as may be necessary, are hereby
10specifically appropriated from the block grant (BG) funds to the
11several hereinafter named agencies of the Executive Department
12of the Commonwealth for the purposes and under the restrictions
13for which the funds are provided for the fiscal year beginning
14July 1, 2013.

15(b) Small Communities Development Block Grant.--The Small
16Communities Development Block Grant (SCDBG) is to assist small
17cities and communities that have a high concentration of
18impoverished citizens and substandard housing to expand their
19low-income and moderate-income housing opportunities and to meet
20community development needs.

21(c) Community Services Block Grant.--The Community Services
22Block Grant (CSBG) is to provide a range of services and
23activities having a measurable and potentially major impact on
24the causes of poverty in the community or those areas of the
25community where poverty is a particularly acute problem. In
26addition, new focus may be placed on the unemployed, both old
27and new. Local agencies may lower their eligibility requirements
28for recipients to three months to allow greater flexibility to
29assure proper consideration of each recipient.

30(d) Preventive Health and Health Services Block Grant.--The

1Preventive Health and Health Services Block Grant (PHHSBG) is
2for the provision of preventive health and other health services
3related to emergency medical systems, health initiative grants,
4comprehensive public health, hypertension, fluoridation, health
5education, risk reduction, home health, rape crisis and domestic
6violence services.

7(e) Maternal and Child Health Services Block Grant.--The
8Maternal and Child Health Services Block Grant (MCHSBG) is to
9enable states to maintain and strengthen their leadership in
10planning, promoting, coordinating and evaluating health care for
11pregnant women, mothers, infants and children, and children with
12special health care needs and in providing health services for
13mothers and children who do not have access to adequate health
14care.

15(f) Low-Income Home Energy Assistance Block Grant.--The Low-
16Income Home Energy Assistance Block Grant (LIHEABG) is to help
17lessen the impact of the high cost of energy on low-income
18families and individuals, including energy efficiency grants for
19low-income dwellings. No less than 15% of the LIHEABG funds
20received shall be used for weatherization. LIHEABG funds
21received pursuant to a Presidential release of contingency funds
22shall be exempt from the 15% requirement.

23(g) Social Services Block Grant.--The Social Services Block
24Grant (SSBG) is for the provision of social services to eligible
25persons.

26(h) Mental Health Services Block Grant.--The Mental Health
27Services Block Grant (MHSBG) provides funds for the provision of
28services to adults with serious mental illness or children with
29serious emotional disturbance.

30(i) Substance Abuse Block Grant.--The Substance Abuse Block

1Grant (SABG) provides funds to establish and maintain programs
2to combat alcohol and drug abuse.

3(j) Child Care and Development Fund Block Grant.--The Child
4Care and Development Fund Block Grant (CCDFBG) is for the
5provision of direct child care or to increase the quality and
6availability of child care for low-income families.

7(k) Temporary Assistance for Needy Families Block Grant.--
8The Temporary Assistance for Needy Families Block Grant (TANFBG)

18Section 1961. Prior laws unaffected.

19This part is not intended to be inconsistent with or to
20repeal any provision of any act enacted at this or any prior
21session of the General Assembly regulating the purchase of
22supplies, the ordering of printing and binding, the purchase,
23maintenance and use of automobiles, the method of making
24payments from the State Treasury for any purpose or the
25functioning of any administrative department, board or
26commission.

27Section 1962. Compliance with other law before funds available.

28No appropriation made by this part to any department, board,
29commission or agency of the Executive Department shall be
30available unless and until the department, board, commission or

1agency has complied with sections 615 and 616 of the act of
2April 9, 1929 (P.L.177, No.175), known as The Administrative
3Code of 1929.

4Section 1963. Contracts prerequisite to encumbering or
5committing funds.

6Funds for the purchase of supplies, materials and equipment
7shall not be deemed to be committed or encumbered until
8contracts covering the purchase have been entered into with the
9vendors.

10Section 1964. Minority business set-asides.

11(a) Duty to report.--Each department or other
12instrumentality of the Commonwealth listed in Subpart B or D
13authorized to contract for buildings, highways, commodities,
14equipment, supplies or services shall report to the General
15Assembly all information pertinent to anticipated procurement
16needs at the beginning of each fiscal year and each fiscal
17quarter thereafter.

18(b) Definition.--As used in this section, the term "minority
19business" means a minority business enterprise as defined in the
20act of July 22, 1974 (P.L.598, No.206), known as the
21Pennsylvania Minority Business Development Authority Act.

22Section 1965. Appropriation of funds from miscellaneous
23sources.

24In addition to the amounts appropriated by this part:

25(1) Moneys received in payment for food and household
26supplies furnished to employees and other persons, except
27inmates, by an institution, and moneys received from the
28proceeds from the sale of any products of the soil, meats,
29livestock, timber or other materials sold by the department
30shall be paid into the General Fund and are hereby

1appropriated out of the General Fund to the several
2respective institutions for the operation and maintenance of
3the institutions.

4(2) Moneys received from any other source, except the
5Federal Government, as contributions for the programs
6provided herein or as payment for services or materials
7furnished by one institution to another, except those
8collections designated as revenues, shall be paid into the
9General Fund and are hereby appropriated out of the General
10Fund for the purposes of the respective appropriations.

11(3) Moneys received by a department or agency of the
12Commonwealth from any other source, except the Federal
13Government, as contributions or supplements to the department
14or agency for a program or administration of an act included
15in this part shall be paid into the General Fund and credited
16to the appropriation for that program or administration of
17that act.

18Section 1966. Lapsing of unused funds.

19(a) General rule.--Except as otherwise provided by law or by
20this section, that part of all appropriations in Part XIX
21unexpended, uncommitted or unencumbered as of June 30, 2013,
22shall automatically lapse as of that date.

23(b) Exception.--The appropriation in Part XIX to the
24Pennsylvania Emergency Management Agency for the Summer 2011
25Storm Disaster Relief shall be a continuing appropriation.

26Section 1967. Construction with prior appropriation acts.

27Any appropriation in Subpart B of this part which is the same
28or similar to any appropriation in the act of June 30, 2012
29(P.L.1740, No.9A), known as the General Appropriation Act of
302012, shall replace that appropriation.

1Section 1968. Deduction of expended appropriations under prior
2law.

3Any money which has been appropriated and expended under the
4act of June 30, 2012 (P.L.1740, No.9A), known as the General
5Appropriation Act of 2012, shall be deducted from the
6corresponding appropriation in this part.

7PART XX

8SPECIAL PROVISIONS FOR FEDERAL FUNDS

9FOR 2013-2014

10Section 2001. General Fund repository for Federal funds.

11All moneys received from the Federal Government as
12contributions or supplements to the departments or agencies of
13the Commonwealth or the programs herein provided shall be paid
14into the General Fund.

15Section 2002. Limitation on encumbering or spending Federal
16funds.

17Federal funds shall be encumbered or spent only to the extent
18that such funds are estimated as being available during the
19fiscal year of the Commonwealth.

20Section 2003. Appropriation of prior unspent Federal funds.

21(a) General rule.--Any Federal money which has been
22previously appropriated by the General Assembly and authorized
23or allocated by the Federal Government but remains unspent from
24prior fiscal years and will not be renewed for fiscal year 2013-
252014 is hereby appropriated.

26(b) Department of Public Welfare.--The Federal
27appropriations to the Department of Public Welfare include any
28prior earnings that may be received during fiscal year 2013-
292014. In addition to the amounts specifically appropriated
30herein to the Department of Public Welfare, all moneys

1appropriated from the Federal Government during any previous
2fiscal year which are expected to be received as reimbursements
3may be carried forward until June 30, 2014, to the extent that
4obligations are carried forward. In addition, any reimbursements
5actually received to support such obligations may also be
6carried forward.

7Section 2004. Subgrants between Federal fund appropriations.

8Subgrants may be made between Federal appropriations without
9further approval of the General Assembly. The Secretary of the
10Budget shall submit a list of subgrants to the chairman and
11minority chairman of the Appropriations Committee of the Senate
12and the chairman and minority chairman of the Appropriations
13Committee of the House of Representatives quarterly. No subgrant
14to a State agency, however, may be made from a restricted
15receipt account without a specific appropriation by the General
16Assembly.

17Section 2005. Utilization of emergency Federal funds.

18(a) Natural disasters and civil disobedience.--Federal funds
19available for costs and damages resulting from natural disasters
20or civil disobedience may be added to an appropriation contained
21in this act or to funds appropriated or may be used for the
22purposes prescribed by the Federal Government.

23(b) Other emergencies.--In addition to the moneys
24appropriated by this act, all moneys received from the Federal
25Government for the purpose of disaster assistance or relief, or
26other moneys received as a direct result of terrorist acts,
27moneys for homeland security and defense and moneys for avian
28flu/pandemic preparedness shall be paid into the General Fund
29and are hereby appropriated out of the General Fund to the
30departments, boards, commissions or agencies designated by the

1Governor.

2(c) Executive authorization.--In the event of any emergency
3situation in which the General Assembly cannot act in sufficient
4time, the Governor is authorized through executive authorization
5to provide up to $10,000,000 in Federal funds to alleviate the
6emergency situation.

7(d) Definition.--For the purposes of this section,
8"emergency" is defined as any situation in which there is a
9chance of or which may result in substantial human suffering.

10Section 2006. Transfer of funds from TANFBG to CCDFBG and SSBG.

11In accordance with Federal law which permits the transfer of
12funds from the TANFBG to the CCDFBG and SSBG, the Department of
13Public Welfare, upon approval of the Secretary of the Budget,
14may make such transfers of funds provided that any such transfer
15will not result in a deficit in any appropriation from which
16funds are transferred. The Secretary of the Budget shall provide
17ten days prior notification of any such transfers to the
18chairman and the minority chairman of the Appropriations
19Committee of the Senate and the chairman and minority chairman
20of the Appropriations Committee of the House of Representatives.

21PART XXI

22MISCELLANEOUS PROVISIONS

23FOR 2013-2014

24Section 2101. Prior laws unaffected.

25This act is not intended to be inconsistent with or to repeal
26any provision of any act enacted at this or any prior session of
27the General Assembly regulating the purchase of supplies, the
28ordering of printing and binding, the purchase, maintenance and
29use of automobiles, the method of making payments from the State
30Treasury for any purpose or the functioning of any

1administrative department, board or commission.

2Section 2102. Compliance with other law before funds available.

3No appropriation made by this act to any department, board,
4commission or agency of the Executive Department shall be
5available unless and until the department, board, commission or
6agency has complied with sections 615 and 616 of the act of
7April 9, 1929 (P.L.177, No.175), known as The Administrative
8Code of 1929.

9Section 2103. Contracts prerequisite to encumbering or

11Funds available to agencies, boards, departments, commissions
12or other governmental entities under this act for the
13procurement of supplies, services or construction shall not be
14available for payment of or to be committed to or encumbered for
15payment of any such procurement unless and until the agency,
16board, department or other governmental entity has complied with
17all of the requirements applicable to the procurement that are
18set out in 62 Pa.C.S. (relating to procurement) and in the
19policies, procedures and regulations instituted in accordance
20with that code.

21Section 2104. Minority business set-asides.

1this section, that part of all appropriations in Parts II, III,
2IV, V, VI, VII, VIII, IX, X, XI, XII, XIII, XIV, XV, XVI, XVII,
3XVIII and XVIII-A unexpended, uncommitted or unencumbered as of
4June 30, 2014, shall automatically lapse as of that date.

5(b) Exceptions.--

6(1) The appropriations in Part II to the Pennsylvania
7Emergency Management Agency for Hazard Mitigation and for the
8Summer 2011 Storm Disaster Relief shall be continuing
9appropriations.

10(2) The appropriations in Part II to the State
11Government Support Agencies shall be continuing
12appropriations.

13(3) The appropriation in Part II to the Supreme Court
14for the unified judicial system security program shall be a
15continuing appropriation.

16(4) The appropriations in Part II to the General
17Assembly shall be continuing appropriations.

18Section 2107. Appellate courts appropriation contingency.

19The funds appropriated in Part II to the Supreme, Superior
20and Commonwealth Courts for justice and judge expenses are
21contingent upon a vouchered expense account plan being continued
22by the Supreme Court.

23Section 2108. Transfer of excess funds.

24The Governor may transfer any excess money in those funds
25receiving proceeds of Commonwealth of Pennsylvania general
26obligation bonds in excess of the amount necessary for the
27purposes for which the bonds were issued to the appropriate
28sinking fund for payment of debt service due on outstanding
29bonds. If such excess funds, together with any available
30balance, exceed the amount of debt service remaining to be paid,

1the funds shall be transferred to the General Fund or to the
2appropriate special fund responsible for such debt service.

3Section 2109. Transfers for government support agencies.

4During fiscal year 2013-2014, any prior year amount
5unexpended on the effective date of the General Appropriation
6Act of 2013 may, upon the written concurrence of the President
7pro tempore of the Senate, the Majority Leader of the Senate,
8the Speaker of the House of Representatives and the Majority
9Leader of the House of Representatives, be transferred between
10any of the following accounts:

11(1) Legislative Reference Bureau.

12(2) Legislative Budget and Finance Committee.

13(3) Legislative Data Processing Committee.

14(4) Joint State Government Commission.
