1Amending Title 66 (Public Utilities) of the Pennsylvania
2Consolidated Statutes, further providing for definitions; and
3prohibiting railroads from operating railroad locomotives in
4reverse in certain instances.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. Section 102 of Title 66 of the Pennsylvania
8Consolidated Statutes is amended by adding definitions to read:

9§ 102. Definitions.

10Subject to additional definitions contained in subsequent
11provisions of this part which are applicable to specific
12provisions of this part, the following words and phrases when
13used in this part shall have, unless the context clearly
14indicates otherwise, the meanings given to them in this section:

16"Class I railroad." As classified under 49 CFR Pt. 1201
17(relating to railroad companies).

18"Class II railroad." As classified under 49 CFR Pt. 1201
19(relating to railroad companies).

1"Class III railroad." As classified under 49 CFR Pt. 1201

4Section 2. Title 66 is amended by adding a section to read:

5§ 2710. Operating railroad locomotives in reverse.

6(a) General rule.--No Class I railroad operating in this
7Commonwealth may operate a railroad locomotive in reverse or
8backup position on any main line or secondary line unless one of
9the following applies:

10(1) When an emergency exists.

11(2) While performing switching operations.

12(3) Where the railroad locomotive is engaged in the
13transportation of passengers.

14(b) Penalty.--Any railroad that violates this section shall
15be subject to a fine of $1,000 for each violation.

16(c) Regulation.--The commission shall promulgate the rules
17and regulations necessary for the implementation of this
18section.

19(d) Enforcement.--The commission shall enforce this section
20and may issue orders as may be proper to require compliance with
21this section.

22(e) Definitions.--As used in this section, the following
23words and phrases shall have the meanings given to them in this
24subsection:

25"Operate a railroad locomotive in reverse or backup
26position." To operate a railroad locomotive such that the
27smokestack or diesel vent is in front of the operator when the
28operator faces the track ahead.

29Section 3. This act shall take effect in 60 days.
