AN ACT

 

1Amending the act of December 18, 2001 (P.L.949, No.114),
2entitled, as amended, "An act establishing a unified 
3workforce investment system; restructuring certain 
4administrative functions, procedures and entities; 
5transferring workforce development functions of Commonwealth 
6agencies; establishing the Pennsylvania Workforce Investment 
7Board; providing for critical job training grants, for 
8guarantees for program quality and performance for workforce 
9development programs, for workforce leadership grants and for 
10industry partnerships; establishing the Keystone Works 
11Program; and authorizing local workforce investment boards," 
12in administration, further providing for membership and for
13functions.

14The General Assembly of the Commonwealth of Pennsylvania
15hereby enacts as follows:

16Section 1. Section 302(a) of the act of December 18, 2001
17(P.L.949, No.114), known as the Workforce Development Act,
18amended July 2, 2010 (P.L.247, No.41), is amended to read:

19Section 302. Membership.

20(a) General rule.--The board shall be established as
21follows:

22(1) The Governor or a designee.

23(2) Four members of the General Assembly:

1(i) Two senators, one appointed by the President pro
2tempore of the Senate and one appointed by the Minority
3Leader of the Senate.

4(ii) Two representatives, one appointed by the
5Speaker of the House of Representatives and one appointed
6by the Minority Leader of the House of Representatives.

7(3) Representatives appointed by the Governor who are:

8(i) Representatives of business, including [private
9sector employers,] businesses engaged in manufacturing, 
10technology, energy and infrastructure development;
11representatives from each of the Commonwealth's marketing
12regions[,]; owners of businesses[,]; chief executive
13officers[,]; other business executives with optimum
14policymaking or hiring authority[,]; members of local
15workforce investment boards; and businesses that reflect
16the employment opportunities in this Commonwealth,
17including large and small employers.

18(ii) Chief elected officials nominated by Statewide
19organizations or associations representing elected
20officials.

21(iii) Representatives of labor organizations who
22have been nominated by State labor federations.

23(iv) Representatives of individuals and
24organizations experienced with respect to youth
25activities.

26(v) Representatives of organizations which have
27experience and expertise in the delivery of workforce
28investment activities, including chief executive officers
29of community colleges, technical colleges and community-
30based organizations in this Commonwealth.

1(v.1) The chair or a [cochair] co-chair of the
2Health Careers Leadership Council of the Pennsylvania
3Center for Health Careers.

4(vi) Lead Commonwealth agency officials, including:

5(A) The Secretary of Aging.

6(B) The Secretary of Community and Economic
7Development.

8(C) The Secretary of Education.

9(D) The Secretary of Labor and Industry.

10(E) The Secretary of Public Welfare.

11(F) The Director of the Governor's Policy
12Office.

13(vii) Any other representative or Commonwealth
14agency official the Governor deems necessary.

15(4) A majority of the board under this subsection must
16be representatives of business.

17(5) The Governor shall solicit recommendations from
18State, regional and local business organizations in making
19appointments to the board.

21Section 2. Section 304(a)(19) of the act, amended December
2216, 2002 (P.L.1930, No.224), is amended to read:

23Section 304. Plan, functions and responsibilities.

24(a) General rule.--The board, in furtherance of section 102,
25shall advise and assist the Governor on all of the following:

27(19) Compilation of an annual report which shall be
28posted and archived electronically to the websites of local 
29workforce investment boards and submitted to [the General
30Assembly,] the Secretary of the Senate and the Chief Clerk of

1the House of Representatives by March 1 and which shall
2include all of the following:

3(i) A detailed explanation of the performance
4measures used and how the performance measures were
5developed.

6(ii) An explanation of the process used to achieve
7continuous improvement of workforce investment
8activities.

9(iii) The anticipated course of actions to be taken
10by the board to encourage continuous improvement in the
11unified system.

12(iv) A list of the membership of the board,
13including name, affiliation, address, telephone number,
14telefax number and electronic mail address.

15(v) An explanation of the process used to negotiate
16levels of local performance.

17(vi) A list of all certified local workforce
18investment boards in this Commonwealth, including each
19local workforce board's negotiated level of local
20performance, each local workforce board's level of
21performance attained and the action taken with respect to
22any local workforce investment board which failed to meet
23its negotiated level of local performance.

24(vii) A copy of the annual report submitted by each
25local workforce investment board to the board.

26(viii) An accounting of Federal and State funds
27expended for workforce investment in the previous fiscal
28year by line item and program.

30Section 3. This act shall take effect in 60 days.
