AN ACT

 

1Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2Consolidated Statutes, further providing for sale or transfer
3of firearms.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 6111(a) of Title 18 of the Pennsylvania
7Consolidated Statutes is amended by adding a paragraph to read:

8§ 6111. Sale or transfer of firearms.

9(a) Time and manner of delivery.--

11(3) The following shall apply:

12(i) No seller shall deliver a pistol or revolver to
13the purchaser or transferee thereof unless the purchaser
14or transferee demonstrates accreditation in a pistol or
15revolver safety education program approved by the
16commissioner. This paragraph shall not apply to any of
17the following:

18(A) A purchaser or transferee who is an

1individual authorized by law to enforce the law when
2acting within the scope of employment.

3(B) A person who meets all of the following:

4(I) Is a member of the active or reserve
5components of the Army, Navy, Air Force, Marine
6Corps or Coast Guard of the United States or a
7member of the National Guard or the National
8Guard of any state.

9(II) Is on active duty.

10(C) A person with a concealed pistol or revolver
11permit.

12(D) A person who demonstrates in a manner
13approved by the commissioner that purchase or
14transfer of the pistol or revolver is a second or
15subsequent purchase or transfer.

16(E) A person that needs a pistol or revolver for
17an immediate personal safety threat, as demonstrated
18by the production of written proof from a State or
19local law enforcement agency.

20(ii) For the purposes of this paragraph, the term
21"pistol or revolver" shall mean any pistol or revolver
22with a barrel length less than 15 inches or any pistol or
23revolver with an overall length of less than 26 inches.
24The barrel length of a pistol or revolver shall be
25determined by measuring from the muzzle of the barrel to
26the face of the closed action, bolt or cylinder,
27whichever is applicable.

29Section 2. This act shall take effect in 60 days.
