AN ACT

 

1Amending the act of April 6, 1951 (P.L.69, No.20), entitled "An
2act relating to the rights, obligations and liabilities of
3landlord and tenant and of parties dealing with them and
4amending, revising, changing and consolidating the law
5relating thereto," providing for eviction for unlawful
6discharge of a firearm in an occupied structure.

7The General Assembly of the Commonwealth of Pennsylvania
8hereby enacts as follows:

9Section 1. The act of April 6, 1951 (P.L.69, No.20), known
10as The Landlord and Tenant Act of 1951, is amended by adding a
11section to read:

12Section 506-A. Eviction for Unlawful Discharge of a Firearm
13in an Occupied Structure.--(a) Conviction of a tenant for
14unlawful discharge of a firearm in an occupied structure in
15violation of 18 Pa.C.S. § 2707.1 (relating to discharge of a
16firearm into an occupied structure) in any portion of a single-
17family dwelling, apartment, multiple dwelling premises or
18tenement building shall be a breach of the condition of the
19lease and shall be grounds for the removal of a tenant from the
20single-family dwelling, apartment, multiple dwelling premises or

1tenement building.

2(b) Failure to remove any tenant for violation of any of the
3provisions of subsection (a) shall not act as a waiver of the
4landlord's rights with regard to the same or any other tenant
5relating to any subsequent acts.

6Section 2. This act shall take effect in 60 days.
