AN ACT

 

1Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2act relating to the public school system, including certain
3provisions applicable as well to private and parochial
4schools; amending, revising, consolidating and changing the
5laws relating thereto," further providing for charter school
6requirements.

7The General Assembly of the Commonwealth of Pennsylvania
8hereby enacts as follows:

9Section 1. Section 1715-A of the act of March 10, 1949
10(P.L.30, No.14), known as the Public School Code of 1949, is
11amended by adding clauses to read:

12Section 1715-A. Charter School Requirements.--Charter
13schools shall be required to comply with the following
14provisions:

16(13) A non-United States citizen shall not own or hold a
17financial interest in or serve on the governing body of any of
18the following:

19(i) A charter school.

20(ii) A business or nonprofit corporation that manages a

1charter school and that receives an appropriation of funds from
2the Commonwealth.

3(iii) A vendor doing business with an entity under subclause
4(i) or (ii).

5(14) (i) No elected official holding office may own or hold
6a financial interest in or serve on the governing body of any of
7the following:

8(A) A charter school.

9(B) A business or nonprofit corporation that manages a
10charter school and that receives an appropriation of funds from
11the Commonwealth.

12(C) A vendor doing business with an entity under subclause
13(A) or (B).

14(ii) Annually, on or before April 30, members of the General
15Assembly shall file an affidavit with the Chief Clerk of the
16Senate or the Chief Clerk of the House of Representatives, as
17applicable, affirming that neither the legislator nor an
18immediate family member of the legislator owns, holds a
19financial interest in or serves on the governing body of an
20entity under subclause (i).

21Section 2. This act shall take effect in 60 days.
