AN ACT

 

1Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2act relating to the public school system, including certain
3provisions applicable as well to private and parochial
4schools; amending, revising, consolidating and changing the
5laws relating thereto," in school districts, requiring radon
6reports; and, in grounds and buildings, requiring radon
7tests.

8The General Assembly of the Commonwealth of Pennsylvania
9hereby enacts as follows:

10Section 1. The act of March 10, 1949 (P.L.30, No.14), known
11as the Public School Code of 1949, is amended by adding sections
12to read:

13Section 223.1. Radon Report.--The board of directors of each
14school district shall contact the parent or guardian of each
15student in writing within ten business days of the start of the
16school year regarding:

17(1) The date the radon testing under section 787 was
18conducted in the school buildings in the school district in the
19prior school year.

20(2) The highest radon level recorded and the school building

1where the level was recorded.

2(3) Notice, if applicable, that no testing has been
3conducted in a particular school building.

4(4) That the Environmental Protection Agency considers radon
5levels above four picocuries per liter to be potentially
6dangerous.

7Section 787. Radon Testing.--(a) Each school district shall
8complete initial radon tests in school buildings in the school
9district as follows:

10(1) Except as set forth in paragraph (3), for a school
11building in existence on the effective date of this section, by
12June 30, 2014.

13(2) For a school building constructed after the effective
14date of this section, within nineteen months of the date of
15occupancy.

16(3) For a school building in existence on the effective date
17of this section but remodeled after the effective date of this
18section, within nineteen months of the date of completion of the
19remodeling.

20(b) Each school district shall continue to make radon tests
21in school buildings in the school districts every five years
22after the initial test in subsection (a).

23(c) The results of the tests shall be on file and available
24for review at each school within the school district.

25Section 2. This act shall take effect in 60 days.
