AN ACT

 

1Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
2act to consolidate, editorially revise, and codify the public
3welfare laws of the Commonwealth," further providing for
4prohibited use of public assistance funds.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. Section 484 of the act of June 13, 1967 (P.L.31,
8No.21), known as the Public Welfare Code, added December 17,
92009 (P.L.598, No.54), is amended to read:

10Section 484. Prohibited Use of Public Assistance Funds.--(a)
<-11It shall be unlawful for any individual to purchase tobacco,

<-12It shall be unlawful for any individual [to]:

13(1) To purchase tobacco, tobacco paraphernalia, liquor or 
14alcohol with [a gift certificate or a gift card which is in the
 

1form of] an electronic benefits transfer card issued to convey 
2public assistance benefits administered by the [Department of 
3Public Welfare] department or a debit card issued to convey 
4support payment moneys. The department shall take appropriate<- 
5measures <-payment moneys.

6(2) To use an electronic benefits transfer card issued to
7convey public assistance benefits administered by the department
8in any transaction in a casino, a gaming establishment or any
9retail establishment that provides adult-oriented entertainment
10in which performers disrobe or perform in an unclothed state for
11entertainment.

12(b) The Pennsylvania Gaming Control Board and the 
13Pennsylvania Liquor Control Board, in consultation with the 
14department, shall take appropriate measures to prevent the use 
15of public assistance funds for the purposes proscribed in this 
16section.

<-17(b) (c) Assistance granted under this article shall not be
18withdrawn or used through a point of sale at any entity licensed
19by the Pennsylvania Gaming Control Board <-or the Pennsylvania
20Liquor Control Board.

21Section 2. This act shall take effect in 60 days.
