AN ACT

 

1Amending the act of April 12, 1951 (P.L.90, No.21), entitled, as
2reenacted, "An act relating to alcoholic liquors, alcohol and
3malt and brewed beverages; amending, revising, consolidating
4and changing the laws relating thereto; regulating and
5restricting the manufacture, purchase, sale, possession,
6consumption, importation, transportation, furnishing, holding
7in bond, holding in storage, traffic in and use of alcoholic
8liquors, alcohol and malt and brewed beverages and the
9persons engaged or employed therein; defining the powers and
10duties of the Pennsylvania Liquor Control Board; providing
11for the establishment and operation of State liquor stores,
12for the payment of certain license fees to the respective
13municipalities and townships, for the abatement of certain
14nuisances and, in certain cases, for search and seizure
15without warrant; prescribing penalties and forfeitures;
16providing for local option, and repealing existing laws,"
17further providing for surrender of club licenses for benefit
18of licensees.

19The General Assembly of the Commonwealth of Pennsylvania
20hereby enacts as follows:

21Section 1. Section 474 of the act of April 12, 1951 (P.L.90,
22No.21), known as the Liquor Code, reenacted and amended June 29,
231987 (P.L.32, No.14), is amended to read:

24Section 474. Surrender of Club Licenses for Benefit of

1Licensees.--Whenever a club license has been returned to the
2board for the benefit of the licensee due to the licensed
3establishment not having been in operation for any reason
4whatsoever for a period of time not exceeding fifteen days, the
5license shall be held by the board for the benefit of the
6licensee for a period of time not exceeding one year, or, upon
7proper application to the board, for an additional year, and the
8license shall be revoked at the termination of the period, and
9transfer of the license shall not be permitted after the
10termination of the period. If a club license has been returned 
11to the board for the benefit of the licensee due to the licensed 
12establishment not being available because of a fire, flood or 
13other similar natural disaster and the licensed establishment 
14remains unavailable at the end of the initial one-year period, 
15the board shall extend the period for additional years, not to 
16exceed three additional years, upon proper annual application to 
17the board.

18Section 2. This act shall take effect in 60 days.
