AN ACT

 

1Amending Title 24 (Education) of the Pennsylvania Consolidated
2Statutes, further providing for Public School Employees'
3Retirement Board.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 8501(a) of Title 24 of the Pennsylvania
7Consolidated Statutes is amended to read:

8§ 8501. Public School Employees' Retirement Board.

9(a) Status and membership.--The board shall be an
10independent administrative board and shall consist of [15] the 
11following members: the Secretary of Education, ex officio; the
12State Treasurer, ex officio; two Senators; two members of the
13House of Representatives; the executive secretary of the
14Pennsylvania School Boards Association, ex officio; [two] three
15to be appointed by the Governor, [at least one of whom shall not
16be a] none of whom shall be either a current or former school
17employee or an officer or employee of the State, and who must 
18possess financial, investment or legal experience; three to be

1elected by the active professional members of the system from
2among their number; [one] three to be elected by annuitants from
3among their number; one to be elected by the active
4nonprofessional members of the system from among their number;
5and [one] two to be elected by members of Pennsylvania public
6school boards from among their number. The appointments made by
7the Governor shall be confirmed by the Senate and each election
8shall be conducted in a manner approved by the board. The terms
9of the appointed and nonlegislative elected members shall be
10three years. The members from the Senate shall be appointed by
11the President pro tempore of the Senate and shall consist of one
12member from the majority and one member from the minority. The
13members from the House of Representatives shall be appointed by
14the Speaker of the House of Representatives and shall consist of
15one member from the majority and one member from the minority.
16The legislative members shall serve on the board for the
17duration of their legislative terms and shall continue to serve
18until 30 days after the convening of the next regular session of
19the General Assembly after the expiration of their respective
20legislative terms or until a successor is appointed for the new
21term, whichever occurs first. The chairman of the board shall be
22elected by the board members. Each ex officio member of the
23board, each elected member of the board and each legislative
24member of the board may appoint a duly authorized designee to
25act in his stead. The designee appointed by a member elected by 
26the active professional members of the system must be an active 
27professional member of the system. The designee appointed by a 
28member elected by annuitants must be an annuitant. The designee 
29appointed by a member elected by the active nonprofessional 
30members of the system must be an active nonprofessional member 

1of the system. The designee appointed by a member elected by 
2members of the Pennsylvania public school boards must be a 
3member of a Pennsylvania public school board.

5Section 2. Nothing in this act may preempt or supersede the
6terms of a collective bargaining agreement in effect on the
7effective date of this act for the term of that collective
8bargaining agreement unless otherwise agreed to in writing by
9the parties to the collective bargaining agreement.

10Section 3. This act shall take effect in 30 days.
