AN ACT

 

1Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2act relating to the public school system, including certain
3provisions applicable as well to private and parochial
4schools; amending, revising, consolidating and changing the
5laws relating thereto," in charter schools, further providing
6for funding for charter schools.

7The General Assembly of the Commonwealth of Pennsylvania
8hereby enacts as follows:

9Section 1. Section 1725-A (a)(3) of the act of March 10,
101949 (P.L.30, No.14), known as the Public School Code of 1949,
11amended June 29, 2002 (P.L.524, No.88), is amended, subsection
12(a) is amended by adding a paragraph and the section is amended
13by adding a subsection to read:

14Section 1725-A. Funding for Charter Schools.--(a) Funding
15for a charter school shall be provided in the following manner:

1(2.1) For the 2013-2014 school year and every school year
2thereafter, a cyber charter school shall receive for each
3student enrolled the same funding for each nonspecial education
4student as provided in clause (2), minus the budgeted
5expenditures of the district of residence for the full
6employer's share of retirement contributions paid to the Public
7School Employees' Retirement System.

8(3) For special education students, the charter school shall
9receive for each student enrolled the same funding as for each
10non-special education student as provided in clause (2) or 
11(2.1), whichever is appropriate, plus an additional amount
12determined by dividing the district of residence's total special
13education expenditure by the product of multiplying the combined
14percentage of section 2509.5(k) times the district of
15residence's total average daily membership for the prior school
16year. This amount shall be paid by the district of residence of
17each student.

19(f) The term "cyber charter school" shall mean an 
20independent public school established and operated under a 
21charter from the Department of Education and in which the school 
22uses technology in order to provide a significant portion of its 
23curriculum and to deliver a significant portion of instruction 
24to its students through the Internet or other electronic means. 
25A cyber charter school must be organized as a public, nonprofit 
26corporation. A charter may not be granted to a for-profit 
27entity.

28Section 2. This act shall take effect in 60 days.
