AN ACT

 

1Amending Title 42 (Judiciary and Judicial Procedure) of the
2Pennsylvania Consolidated Statutes, in limitation of time
3relating to criminal proceedings, further providing for no
4limitation applicable and for other offenses.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. Sections 5551 and 5552(b)(1) of Title 42 of the
8Pennsylvania Consolidated Statutes are amended to read:

9§ 5551. No limitation applicable.

10A prosecution for the following offenses may be commenced at
11any time:

12(1) Murder.

13(2) Voluntary manslaughter.

14(3) Conspiracy to commit murder or solicitation to
15commit murder if a murder results from the conspiracy or
16solicitation.

17(4) Any felony alleged to have been perpetrated in

1connection with a murder of the first or second degree, as
2set forth in 18 Pa.C.S. § 2502(a) or (b) and (d) (relating to
3murder).

4(5) A violation of 75 Pa.C.S. § 3742 (relating to
5accidents involving death or personal injury) or 3732
6(relating to homicide by vehicle) if the accused was the
7driver of a vehicle involved in an accident resulting in the
8death of any person.

9(6) A violation of 18 Pa.C.S. § 2702(a)(1), (2), (4) or
10(7) (relating to aggravated assault) if the accused knew the
11victim was a law enforcement officer and the law enforcement
12officer was acting within the scope of the officer's duties.

13(7) A violation of 18 Pa.C.S. § 3212 (relating to
14infanticide).

17(b) Major offenses.--A prosecution for any of the following
18offenses must be commenced within five years after it is
19committed:

20(1) Under the following provisions of Title 18 (relating
21to crimes and offenses):

22Section 901 (relating to criminal attempt) involving
23attempt to commit murder where no murder occurs.

24Section 902 (relating to criminal solicitation)
25involving solicitation to commit murder where no murder
26occurs.

27Section 903 (relating to criminal conspiracy)
28involving conspiracy to commit murder where no murder
29occurs.

30Section 911 (relating to corrupt organizations).

1Section 2702 (relating to aggravated assault).

2Section 2706 (relating to terroristic threats).

3Section 2713 (relating to neglect of care-dependent
4person).

5Section 2901 (relating to kidnapping).

6Section 3211 (relating to abortion on unborn child of
724 or more weeks gestational age).

8Section 3301 (relating to arson and related
9offenses).

10Section 3502 (relating to burglary).

11Section 3701 (relating to robbery).

12Section 3921 (relating to theft by unlawful taking or
13disposition) through section 3933 (relating to unlawful
14use of computer).

15Section 4101 (relating to forgery).

16Section 4107 (relating to deceptive or fraudulent
17business practices).

18Section 4108 (relating to commercial bribery and
19breach of duty to act disinterestedly).

20Section 4109 (relating to rigging publicly exhibited
21contest).

22Section 4117 (relating to insurance fraud).

23Section 4701 (relating to bribery in official and
24political matters) through section 4703 (relating to
25retaliation for past official action).

26Section 4902 (relating to perjury) through section
274912 (relating to impersonating a public servant).

28Section 4952 (relating to intimidation of witnesses
29or victims).

30Section 4953 (relating to retaliation against

1witness, victim or party).

2Section 5101 (relating to obstructing administration
3of law or other governmental function).

4Section 5111 (relating to dealing in proceeds of
5unlawful activities).

6Section 5512 (relating to lotteries, etc.) through
7section 5514 (relating to pool selling and bookmaking).

8Section 5902(b) (relating to prostitution and related
9offenses).

10Section 6111(g)(2) and (4) (relating to sale or
11transfer of firearms).
