AN ACT

 

1Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2Consolidated Statutes, in firearms and other dangerous
3articles, prohibiting certain assault weapons.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Title 18 of the Pennsylvania Consolidated
7Statutes is amended by adding a section to read:

8§ 6121.1. Certain assault weapons prohibited.

9(a) Offense defined.--Except as set forth in subsection (b),
10a person may not do any of the following:

11(1) Possess, use, control, sell, transfer or manufacture
12an assault weapon or obtain a license to possess, use,
13control, sell, transfer or manufacture an assault weapon.

14(2) Obtain a license to do, in this Commonwealth, any of
15the acts under paragraph (1).

16(b) Exception.--Subsection (a) shall not apply to a member
17of the armed forces of the United States or a reserve component

1of the armed forces of the United States, the National Guard or
2a law enforcement officer while performing official duties or
3traveling to or from an authorized place of duty if possession
4of the assault weapon is authorized under applicable statute,
5regulation or military or law enforcement policy.

6(c) Definition.--As used in this section, the term "assault 
7weapon" means:

8(1) Any selective-fire firearm capable of fully
9automatic, semiautomatic or burst fire at the option of the
10user or any of the other following specified semiautomatic
11firearms:

18(2) A part or combination of parts designed or intended
19to convert a firearm into an assault weapon, as defined in
20paragraph (1) or any combination of parts from which an
21assault weapon, as defined in paragraph (1), may be rapidly
22assembled if those parts are in possession or under the
23control of the same person.

24(3) Any semiautomatic firearm not listed in paragraph
25(1) that meets the following criteria:

26(i) a semiautomatic rifle that has an ability to
27accept a detachable magazine and has at least two of the
28following:

29(A) a folding or telescoping stock;

30(B) a pistol grip that protrudes conspicuously

1beneath the action of the weapon;

2(C) a bayonet mount;

3(D) a flash suppressor or threaded barrel
4designed to accommodate a flash suppressor; and

5(E) a grenade launcher;

6(ii) a semiautomatic pistol that has an ability to
7accept a detachable magazine and has at least two of the
8following:

9(A) an ammunition magazine that attaches to the
10pistol outside of the pistol grip;

11(B) a threaded barrel capable of accepting a
12barrel extender, flash suppressor, forward handgrip
13or silencer;

14(C) a shroud that is attached to, or partially
15or completely encircles, the barrel and that permits
16the shooter to hold the firearm with the nontrigger
17hand without being burned;

18(D) a manufactured weight of 50 ounces or more
19when the pistol is unloaded; and

20(E) a semiautomatic version of an automatic
21firearm; or

22(iii) a semiautomatic shotgun that has at least two
23of the following:

24(A) a folding or telescoping stock;

25(B) a pistol grip that protrudes conspicuously
26beneath the action of the weapon;

27(C) a fixed magazine capacity in excess of five
28rounds; and

29(D) an ability to accept a detachable magazine.

30(4) A part or combination of parts designed or intended

1to convert a firearm into an assault weapon, as defined in
2paragraph (3), or any combination of parts from which an
3assault weapon, as defined in paragraph (3), may be rapidly
4assembled if those parts are in the possession or under
5control of the same person.

6The term "assault weapon" does not include any firearm modified
7to render it permanently inoperable.

8Section 2. This act shall take effect in 60 days.
