1Amending Title 61 (Prisons and Parole) of the Pennsylvania
2Consolidated Statutes, in Pennsylvania Board of Probation and
3Parole, further providing for parole power.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 6137 of Title 61 of the Pennsylvania
7Consolidated Statutes is amended by adding a subsection to read:

8§ 6137. Parole power.

10(g.1) Electronic monitoring devices.--

11(1) The board may not release a person on parole who, as
12a term or condition of the person's parole, is subject to an
13electronic monitoring device, unless a telephone landline
14exists and is in operating condition at the dwelling where
15the eligible offender will reside and the telephone landline
16will permit the electronic monitoring device to function
17properly.

18(2) After a person to whom paragraph (1) applies is

1released from a correctional institution or county prison, a
2parole officer shall escort the person from the correctional
3institution or county prison to a parole office where an
4electronic monitoring device shall be placed on the person.

6Section 2. This act shall take effect in 60 days.
