1Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2Consolidated Statutes, in assault, further providing for the
3offense of ethnic intimidation.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 2710(a) and (c) of Title 18 of the
7Pennsylvania Consolidated Statutes are amended to read:

8§ 2710. Ethnic intimidation.

9(a) Offense defined.--A person commits the offense of ethnic
10intimidation if, with malicious intention toward the race,
11color, religion [or], national origin or physical or mental 
12disability of another individual or group of individuals, he
13commits an offense under any other provision of this article or
14under Chapter 33 (relating to arson, criminal mischief and other
15property destruction) exclusive of section 3307 (relating to
16institutional vandalism) or under section 3503 (relating to
17criminal trespass) with respect to such individual or his or her
18property or with respect to one or more members of such group or

1to their property.

3(c) Definition.--As used in this section "malicious
4intention" means the intention to commit any act, the commission
5of which is a necessary element of any offense referred to in
6subsection (a) motivated by hatred toward the race, color,
7religion [or], national origin or physical or mental disability
8of another individual or group of individuals.

9Section 2. This act shall take effect in 60 days.
