AN ACT

 

1Amending Title 4 (Amusements) of the Pennsylvania Consolidated
2Statutes, further providing for general and specific powers;
3and providing for child endangerment protection.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 1202(b) of Title 4 of the Pennsylvania
7Consolidated Statutes is amended by adding a paragraph to read:

8§ 1202. General and specific powers.

10(b) Specific powers.--The board shall have the specific
11power and duty:

13(35) Notwithstanding any other provision of law, to levy 
14fines against a licensed gaming entity or any affiliate, 
15intermediary, subsidiary or holding company of a licensed 
16gaming entity for two or more violations in a one-year period 
17of individuals leaving a child under 14 years of age 
18unattended in a vehicle on property, including a parking 

1area, that is owned, leased or controlled by a licensed 
2gaming entity or any affiliate, intermediary, subsidiary or 
3holding company of a licensed gaming entity.

4Section 2. Title 4 is amended by adding a section to read:

5§ 1509.2. Child endangerment protection.

6(a) Posting of signs.--

7(1) Each licensed gaming entity shall post signs
8regarding the violation of leaving a child under 14 years of
9age unattended in a vehicle on its property or in its parking
10areas and the penalties for such violation.

11(2) The signs shall be posted in clear view in the
12parking areas, at each entrance and exit and in other
13appropriate public areas of the licensed facility as
14determined by the licensed gaming entity and as approved by
15the board.

16(3) The board shall determine the written content and
17minimum number of signs to be posted at each licensed
18facility.

19(b) Fine.--A licensed gaming entity that fails to post the
20signs in accordance with subsection (a) shall be assessed a fine
21of $1,000 a day for each day the minimum number of signs is not
22posted.

23(c) Definition.--As used in this section, the term "parking
24area" means all parcels of land, buildings and improvements
25owned, leased or controlled by a licensed gaming entity or any
26affiliate, intermediary, subsidiary or holding company of a
27licensed gaming entity that are associated with or contiguous
28with or adjoined directly to the licensed facility and in which
29or on which vehicles park.

30Section 3. This act shall take effect in 60 days.
